11. Upon notice and request to the Port Warden by any party interested, the Port Warden or one of his Deputies shall proceed in person to any warehouse, dwelling or wharf, and examine any merchandise, package, material, produce or other property said to have been damaged on board of any vessel, first notifying the master, agent or other representative of such vessel thereof, and shall enquire and examine into and ascertain the nature, cause and extent of such damage, make a memorandum thereof, and record in the books of his office a full and complete statement thereof; and the Port Warden shall be entitled to call in one or two experts in his discretion, who shall assist him in such survey, and who shall make and sign a report on the same to be kept in the office of the Port Warden, and who shall, for such service, be entitled to a fee; and the cost of the survey shall be paid by the party or parties calling for the survey and shall be a lawful charge against any person liable for such damage to the party calling for such survey: Provided always, that such party shall notify the person so liable, his agent or representative (if he be resident or have a place of business in Montreal) of the intention to hold such survey, and of the time and place thereof.

Denis Coderre: With respect to the safety management systems (SMS) put in place by airlines since 2005, and following the appearance of the Chair of the Canadian Federal Pilots Association before the Standing Committee on Transport, Infrastructure and Communities on February 21, 2007: (a) how many SMS inspections were carried out by Transport Canada inspectors, and on which airlines; (b) for each inspection carried out by Transport Canada, was the airline in compliance with the security regulations in place at the time of inspection; (c) for each inspection that was completed on an airline that was not in compliance with the regulations, what measures were taken by the airline to ensure that compliance was achieved; (d) did Transport Canada verify Aveos SMS compliance and, if yes, when will its report be concluded; and (e) does Transport Canada intend to review the SMS regulations that airlines are subject to in the near future?

On completion of an inspection, a more detailed inspection or an expanded inspection, the inspector shall draw up a report in accordance with Annex IX. The ship's master shall be provided with a copy of the inspection report.

Obviously, the captain is in charge of his ship and the chief engineer is in charge of his engine room, but the owners and operators will be responsible for providing equipment that's in good shape, and the training of the personnel, etc (1550) One of the things that we, and also particularly the Americans, discover when we have gone on board and have done investigations is that fairly frequently in cases where, as I said, we've gone on with cause, we find that their records appeared to be falsified with the deliberate intent to mislead authorities, both in Canada and elsewhere, into believing that something took place that didn't take place.
