Lorsqu'une appellation d'origine ou une indication géographique est protégée au titre du présent règlement, l'enregistrement d'une marque commerciale correspondant à l'une des situations visées à l'article 45, paragraphe 2, et concernant un produit relevant d'une des catégories répertoriées à l'annexe IV est refusé si la demande d'enregistrement de la marque commerciale est présentée après la date de dépôt auprès de la Commission de la demande de protection de l'appellation d'origine ou de l'indication géographique et que cette demande aboutit à la protection de l'appellation d'origine ou l'indication géographique.
1. Where a designation of origin or a geographical indication is protected under this Regulation, the registration of a trademark corresponding to one of the situations referred to in Article 45(2) and relating to a product falling under one of the categories listed in Annex IV shall be refused if the application for registration of the trademark is submitted after the date of submission of the application for protection of the designation of origin or geographical indication to the Commission and the designation of origin or geographical indication is subsequently protected.

2. Without prejudice to Article 43(2), a trademark the use of which corresponds to one of the situations referred to in Article 45(2), which has been applied for, registered or established by use, if that possibility is provided for by the legislation concerned, in the territory of the Community before the date on which the application for protection of the designation of origin or geographical indication is submitted to the Commission, may continue to be used and renewed notwithstanding the protection of a designation of origin or geographical indication, provided that no grounds for the trademark's invalidity or revocation exist as specified by the First Council Directive 89/104/EEC of 21 December 1988 to approximate the laws of the Member States relating to trade marks or Council Regulation (EC) No 40/94 of 20 December 1993 on the Community trade mark

In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission as regards laying down rules on the form of the product specification; laying down detailed rules on the form and content of the register of protected designations of origin and protected geographical indications; defining the technical characteristics of the Union symbols and indications as well as the rules on their use on products, including the appropriate linguistic versions to be used; granting and extending transitional periods for temporary derogations for use of protected designations of origin and protected geographical indication; laying down detailed rules on the form and content of the register of traditional specialities guaranteed; laying down rules for the protection of traditional specialities guaranteed; laying down all measures relating to forms, procedures and other technical details for the application of Title IV; laying down rules for the use of optional quality terms; laying down rules for the uniform protection of indications, abbreviations and symbols referring to the quality schemes; laying down detailed rules on the procedure, form and presentation of applications for registration and of oppositions; rejecting the application; deciding on the registration of a name if an agreement has not been reached; laying down detailed rules on the procedure, form and presentation of an amendment application; cancelling the registration of a protected designation of origin, a protected geographical indication or a traditional speciality guaranteed; and laying down detailed rules on the procedure and form of the cancellation process and on the presentation of the requests for cancellation.

Lorsqu’une appellation d’origine ou une indication géographique est protégée au titre du présent règlement, l’enregistrement d’une marque commerciale correspondant à l’une des situations visées à l’article 118 quaterdecies, paragraphe 2, et concernant un produit relevant d’une des catégories répertoriées à l’annexe XI ter est refusé si la demande d’enregistrement de la marque commerciale est présentée après la date de dépôt auprès de la Commission de la demande de protection de l’appellation d’origine ou de l’indication géographique et que cette demande aboutit à la protection de l’appellation d’origine ou l’indication géographique.

The specific and exceptional quality of ‘Slovenská parenica’ is borne out by the fact that its name is protected under two bilateral agreements. These are the Agreement of 18 May 1987 between the Government of the Czechoslovak Socialist Republic and the Government of the Republic of Portugal on the protection of designations of origin, data of origin and other geographical and analogous indications and the Agreement of 20 January 1981 between the Czechoslovak Socialist Republic and the Republic of Austria on protection of designations of origin, data of origin and other designations of agricultural and industrial products.

With due regard to Community law, a trademark the use of which corresponds to one of the situations referred to in Article 13 which has been applied for, registered, or established by use, if that possibility is provided for by the legislation concerned, in good faith within the territory of the Community, before either the date of protection of the designation of origin or geographical indication in the country of origin or before 1 January 1996, may continue to be used notwithstanding the registration of a designation of origin or geographical indication, provided that no grounds for its invalidity or revocation exist as specified by First Council Directive 89/104/EEC of 21 December 1988 to approximate the laws of the Member States relating to trade marks (8) or Council Regulation (EC) No 40/94 of 20 December 1993 on the Community trade mark (9).
