Le demandeur fait ensuite référence à la jurisprudence de la Cour européenne des droits de l’homme (ci-après la « Cour EDH ») concernant l’interprétation de l’article 6 de la CEDH selon laquelle, d’une part, la convocation des parties à l’audience devrait leur permettre non seulement de connaître la date et le lieu de cette audience, mais aussi de disposer de suffisamment de temps pour préparer leur affaire et pour comparaître devant la juridiction et, d’autre part, un simple envoi formel d’une lettre de notification sans aucune certitude de sa remise en temps utile au requérant ne saurait être considéré comme une notification en bonne et due forme . En outre, le demandeur fait référence à l’arrêt Kapetanios et autres c. Grèce dans lequel la Cour EDH a jugé que le fait d’infliger des sanctions pécuniaires administratives à des personnes accusées de contrebande qui ont été relaxées constitue une violation de l’article 6, paragraphe 2, de la CEDH, relatif à la présomption d’innocence, et de l’article 4 du Protocole n 7, concernant le droit à ne pas être jugé ou puni pénalement deux fois pour une même infraction.
