(11) Whereas, for the other still little known fields of the Information Society, it would, however, be premature to coordinate national rules and regulations by means of extensive or exhaustive harmonisation at Community level of the substantive law, given that enough is not yet known about the form the new services will take or their nature, that there is as yet at national level no specific regulatory activity in this field, and that the need for, and content of, such harmonisation in the light of the internal market cannot be defined at this stage;

(6) considérant que, en l'absence d'une telle harmonisation minimale et dans un souci de protéger les investisseurs, les États membres d'accueil peuvent s'estimer fondés à obliger les entreprises d'investissement des autres États membres qui opèrent par l'intermédiaire des succursales ou par voie de prestation de services à adhérer au système d'indemnisation de l'État membre d'accueil lorsqu'elles ne sont pas affiliées à un système d'indemnisation des investisseurs dans leur État membre d'origine ou lorsque ledit système est considéré comme n'offrant pas une protection équivalente; qu'une telle exigence pourrait être préjudiciable au fonctionnement du marché intérieur;
(6) Whereas, in the absence of such minimum harmonization, a host Member State might consider itself justified, by considerations of investor protection, in requiring membership of its compensation scheme when a Community investment firm operating through a branch or under the freedom to provide services either belonged to no investor-compensation scheme in its home Member State or belonged to a scheme which was not regarded as offering equivalent protection; whereas such a requirement might prejudice the operation of the internal market;
