Accordingly, in its internal draft of 6 September 2006 ‘A horizontal legislative approach to the harmonisation of legislation on industrial products’ (N 560 - 1 EN), the Commission had planned only a legislative proposal directly affecting current law.

Welcomes the fact that new Member States have implemented the Mutual Recognition principle in their legislation, and, furthermore, that some Member States have also adopted a horizontal mutual recognition clause which automatically recognises this principle in non-harmonised areas, but reaffirms the need to progress towards upwards harmonisation as a key objective of the Internal Market;

Besides the demand for increased coherence in Community law, the Council report would seem to favour a more horizontal approach to harmonisation, aiming at the creation of a European common core of private law if a need for harmonisation is revealed.

(16) Liability for activities in the network environment concerns not only copyright and related rights but also other areas, such as defamation, misleading advertising, or infringement of trademarks, and is addressed horizontally in Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the internal market ("Directive on electronic commerce")(4), which clarifies and harmonises various legal issues relating to information society services including electronic commerce.

The proposal harmonises the regulatory framework for the horizontal provisions regarding food labelling and thus contributes to consumer protection by ensuring that consumers receive appropriate information to enable them to make informed, safe, healthy and sustainable choices. The proposed measures are sufficient in terms of reaching the objectives of ensuring consumers are enabled to make informed choices and to securing the smooth functioning of the internal market. At the same time they do not impose an excessive or unjustified burden.
