[77] 7 Grounds for refusal: (a) where enforcement would run counter to the fundamental principles of the legal system of the requested State; (b) where the requested State considers the offence for which the sentence was passed to be of a political nature or a purely military one; (c) where the requested State considers that there are substantial grounds for believing that the sentence was brought about or aggravated by considerations of race, religion, nationality or political opinion; (d) where enforcement would be contrary to the international undertakings of the requested State; (e) where the act is already the subject of proceedings in the requested State or where the requested State decides to institute proceedings in respect of the act; (f) where the competent authorities in the requested State have decided not to take proceedings or to drop proceedings already begun, in respect of the same act; (g) where the act was committed outside the territory of the requesting State; (h) where the requested State is unable to enforce the sentence; (i) where the request is grounded on Article 5.e ("if it considers that it cannot itself enforce the sanction, even by having recourse to extradition, and that the other State can") and none of the other conditions mentioned in that article is fulfilled; (j) where the requested State considers that the requesting State is itself able to enforce the sentence; (k) where the age of the sentenced person at the time of the offence was such that he could not have been prosecuted in the requested State; (l) where under the law of the requested State the sentence imposed can no longer be enforced because of the lapse of time; (m) where and to the extent that the sentence imposes a disqualification.

La personne assurée qui s'est vu reconnaître, pour elle-même ou pour un membre de sa famille, le droit à une prothèse, à un grand appareillage ou à d'autres prestations en nature d'une grande importance, par l'institution d'un État membre, avant d'être assurée en vertu de la législation appliquée par l'institution d'un autre État membre, bénéficie de ces prestations à la charge de la première institution, même si elles sont accordées alors que ladite personne est déjà assurée en vertu de la législation appliquée par la deuxième institution.
1. An insured person or a member of his/her family who has had a right to a prosthesis, a major appliance or other substantial benefits in kind recognised by the institution of a Member State, before he/she became insured under the legislation applied by the institution of another Member State, shall receive such benefits at the expense of the first institution, even if they are awarded after the said person has already become insured under the legislation applied by the second institution.

La charge qu'elle supporterait, si elle était soumise avec le même effectif en activité et les mêmes rémunérations au régime de référence, est déterminée par application des dispositions législatives, réglementaires ou administratives qui organisent ce régime.
The financial burden which the undertaking would bear if, with the same number of persons actively employed and receiving the same remuneration, it were subject to the scheme taken as a basis of comparison, shall be determined by applying the provisions laid down by law, regulation or administrative action governing such scheme.

En ce qui concerne les charges visées sous A point 1, l'indemnité compensatrice est égale à la différence entre la charge supportée par l'entreprise et celle qu'elle supporterait si elle était soumise, avec le même effectif en activité et les mêmes rémunérations, soit au régime de droit commun (régime général de sécurité sociale et régimes complémentaires obligatoires), soit au régime des autres modes de transport.

With regard to payments covered by A (1), compensation shall be equal to the difference between the financial burden which the undertaking bears and that which it would bear if, with the same number of persons actively employed and receiving the same remuneration, they were subject either to the scheme under the general law (general social security scheme or compulsory supplementary schemes) or to the scheme applicable to other modes of transport.
