Ce désavantage était la conséquence d’une différence de traitement disproportionnée en raison de la langue, interdite par l’article 21 de la Charte.
The Court found that a potential candidate whose mother tongue was not one of the languages of full publication of the contested competition notices was at a disadvantage compared to a candidate whose mother tongue was one of those three languages. That disadvantage was the consequence of a disproportionate difference in treatment on the ground of language, prohibited by Article 21 of the Charter.

In C-435/97 World Wildlife Fund and Others v Autonome Sektion Provinz Bozen and Others (the Bozen Case) the issue at stake was whether an EIA has to be carried out in cases of a mixed airport (military and commercial) and the ECJ concluded that the exemption in Article 1 (4) only applies to projects, which serve mainly national defence purposes; as the issue of a mixed use was in question the ECJ ruled that the EIA Directive applied.

Considering that Freixenet could not have been unaware of that idea, the Court held that Freixenet was therefore perfectly able to refute the argument put forward by the examiner and then accepted by the First Board of Appeal to establish the absence of any distinctive character of the marks for which registration was sought; it could thus have argued that it was not the label but the packaging of the sparkling wine which was normally taken into consideration by the consumer concerned in choosing that product.
