2. 2. By way of derogation from point (a) of paragraph 1, where a Member State has been allocated fishing opportunities for species listed in Annex I before 12 January 2017, but its vessels have not caught 10 tonnes or more of deep-sea species in any of the reference years, the aggregate fishing capacity of such Member State shall at no time exceed the aggregate fishing capacity of its vessels in any of the three latest years in which at least one of its vessels caught 10 tonnes or more of deep-sea species, whichever year provides the higher figure.

La mission effectuée par la Commission a révélé que, même si la législation du Vanuatu fixe un plafond général des amendes à 100 000 000 VUV (environ 830 000 EUR) en cas d’infraction aux conditions applicables aux autorisations de pêche internationales (109), aucun navire ne s’est jamais vu appliquer une sanction correspondant à cette amende maximale pour des opérations illégales menées en haute mer.
The mission conducted by the Commission revealed that, in spite of the fact that Vanuatu legislation sets a general maximum limit for fines at VUV 100 000 000 (approximately EUR 830 000) for infringements of the conditions applicable to international authorisations to fish (109), no vessels has never been applied a sanction corresponding to that maximum fine for illegal operations conducted on the high seas.

La Commission a en effet considéré qu’il s’agissait d’aides au fonctionnement bénéficiant au FPAP et aux entreprises de pêche et qu’aucune disposition du TFUE ou d’un instrument quelconque adopté par la Commission en matière d’aides d’État ne permettait de considérer ces aides comme étant compatibles avec le marché intérieur.
The Commission found that the aid in question was operating aid in respect of the FPAP and fisheries undertakings and that no provision of the TFEU or any State aid instrument adopted by the Commission constituted a basis for asserting that such aid was compatible with the common market.

(4) Afin de faire en sorte que les niveaux actuels globaux de l'effort de pêche ne connaissent aucun accroissement, il y a lieu de mettre en place un nouveau régime de gestion de l'effort de pêche dans les zones CIEM V, VI, VII, VIII, IX et X, ainsi que dans les zones Copace 34.1.1, 34.1.2, et 34.2.0.
