Within ten working days of the completion of the clearing transactions set out in Article 56, the Union registry shall delete Chapter II allowances valid for the 2008-2012 period held in user accounts in the Union registry and issue an equal amount of Chapter II allowances valid for the 2013-2020 period to the same accounts and delete Chapter III allowances valid for the 2008-2012 period held in user accounts in the Union registry and issue an equal amount of Chapter III allowances valid for the 2013-2020 period to the same accounts’.

Each operator of a stationary installation which received a free allocation for the period from 2008 to 2012 and carrying out activities not listed in Annex I of Directive 2003/87/EC as amended by Regulation (EC) No 219/2009 of the European Parliament and of the Council , but listed in Annex I of Directive 2003/87/EC as amended by Directive 2009/29/EC of the European Parliament and of the Council shall be entitled to use international credits during the period from 2008 to 2020 up to the amount allowed to them from the period from 2008 to 2012, or to an amount corresponding to a maximum of 11 % of their allocation during the period from 2008 to 2012, or up to a maximum of 4,5 % of their verified emissions during the period from 2013 to 2020, whichever is the higher.

Each operator of a stationary installation with a significant capacity extension pursuant to Article 20 of Decision 2011/278/EU shall be entitled to use international credits during the period from 2008 to 2020 up to the amount allowed to it in the period from 2008 to 2012, or to an amount corresponding to a maximum of 11 % of their allocation during the period from 2008 to 2012, or up to a maximum of 4,5 % of their verified emissions during the period from 2013 to 2020, whichever is the higher.

2. Tout exploitant d’une installation fixe qui n’a reçu ni allocation à titre gratuit, ni autorisation d’utiliser des crédits internationaux au cours de la période 2008-2012 et, par dérogation au paragraphe 1, tout exploitant d’une installation fixe au sens de l’article 3, point h), premier et deuxième tirets, de la directive 2003/87/CE, est en droit d’utiliser des crédits internationaux au cours de la période 2008-2020, jusqu’à concurrence de 4,5 % de ses émissions vérifiées pour la période 2013-2020.
2. Each operator of a stationary installation which received neither a free allocation nor an entitlement to use international credits in the period from 2008 to 2012 and, by derogation from paragraph 1, each operator of a stationary installation within the meaning of the first two indents of Article 3(h) of Directive 2003/87/EC shall be entitled to use international credits in the period from 2008 to 2020 up to a maximum of 4,5 % of its verified emissions in the period from 2013 to 2020.

All existing operators shall be allowed to use credits during the period from 2008 to 2020 up to either the amount allowed to them during the period from 2008 to 2012, or to an amount corresponding to a percentage, which shall not be set below 11 %, of their allocation during the period from 2008 to 2012, whichever is the highest.

Il convient aussi que les États membres puissent utiliser les crédits de réduction des émissions de gaz à effet de serre liés à des réductions réalisées après la période 2008-2012 qui résultent de projets enregistrés durant la période 2008-2012 et correspondant à des types de projets autorisés dans le cadre du système communautaire pendant cette période.
Member States should also be able to use greenhouse gas emission reduction credits for reductions that were made after the period from 2008 to 2012, that result from projects that were registered during the period from 2008 to 2012 and that result from project types which were eligible for use in the Community scheme during that period.

Étant donné que la Communauté œuvre pour une répartition équitable des projets relevant du MDP, notamment grâce à l’Alliance mondiale contre le changement climatique proposée par la Commission dans sa communication du 18 septembre 2007 intitulée «Construire une alliance mondiale contre le changement climatique entre l’Union européenne et les pays en développement pauvres et les plus vulnérables au changement climatique», il y a lieu d’offrir des garanties quant à l’acceptation des crédits résultant de projets lancés après la période 2008-2012 dans les PMA et appartenant à des types de projets autorisés dans le cadre du système communautaire durant la période 2008-2012.
Given that the Community supports the equitable distribution of CDM projects, including through the Commission’s Global Climate Change Alliance as set out in the Commission Communication of 18 September 2007 entitled ‘Building a Global Climate Change Alliance between the European Union and poor developing countries most vulnerable to climate change’, it is appropriate to provide certainty on the acceptance of credits from projects started after the period from 2008 to 2012 in LDCs, for project types that were eligible for use in the Community scheme during the period from 2008 to 2012.
