TRADUCTIONS EN CONTEXTE

Concernant la coopération judiciaire en matière civile et pénale, plusieurs accords internationaux restaient à ratifier.
A number of international agreements on judicial cooperation in civil and criminal law still needed to be ratified.

Sans préjudice de l’indépendance de la justice ni de la diversité dans l’organisation des ordres judiciaires dans l’Union, les États membres demandent aux personnes chargées de la formation des juges, des procureurs et du personnel de justice intervenant dans les procédures pénales d’accorder une attention particulière aux spécificités de la communication avec l’assistance d’un interprète, afin d’assurer une communication efficace et effective.
Without prejudice to judicial independence and differences in the organisation of the judiciary across the Union, Member States shall request those responsible for the training of judges, prosecutors and judicial staff involved in criminal proceedings to pay special attention to the particularities of communicating with the assistance of an interpreter so as to ensure efficient and effective communication.

This Decision shall be without prejudice to the obligations resulting from European Union instruments on mutual legal assistance or on mutual recognition of decisions regarding criminal matters, from bilateral or multilateral agreements or arrangements between the Member States and third countries on mutual legal assistance and from Decision 2000/642/JHA and Framework Decision 2006/960/JHA.

En France, l'article 41-1 point 5 du code de procédure pénale permet au procureur de la République de recourir, pour la « petite délinquance » (délits ou contraventions), à une médiation pénale avec l'accord de la victime et de l'auteur de l'infraction pénale, préalablement à sa décision sur l'action publique, s'il lui apparaît qu'une telle mesure est susceptible d'assurer la réparation du dommage causé à la victime, de mettre fin au trouble résultant de l'infraction ou de contribuer au reclassement de l'auteur des faits.
In France, Article 41-1(5) of the Code of Criminal Procedure allows the public prosecutor to use mediation in cases of petty crime (misdemeanours or petty offences), with the consent of the victim and the offender, before deciding whether to take criminal proceedings, if he feels that this will ensure that reparation is made to the victim, that any difficulties arising from the offence will be resolved and that it will help with the rehabilitation of the offender.

[61] IN ADDITION TO MUTUAL LEGAL ASSISTANCE IN CRIMINAL JUSTICE, THE EU/US AGREEMENT ALSO ADDRESSES AREAS MORE SPECIFIC TO FINANCIAL CRIME, NOTABLY EXCHANGE OF BANK ACCOUNT INFORMATION RELATING TO LEGAL OR PHYSICAL PERSONS SUSPECTED OF OR CHARGED WITH A CRIMINAL OFFENCE.
