8. Points out that the Prüm Decision was adopted under the former third pillar and that its implementation is lacking proper democratic oversight and control by Parliament; calls on the Commission to speedily bring forward proposals to bring the existing cross-border police cooperation instruments adopted under the former third pillar – such as the Prüm Decision and the Swedish Initiative – within the legal framework of the Lisbon Treaty;

Following the entry into force of the Treaty between the Kingdom of Belgium, the Federal Republic of Germany, the Kingdom of Spain, the French Republic, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands and the Republic of Austria on the stepping up of cross-border cooperation, particularly in combating terrorism, cross-border crime and illegal migration hereinafter (Prüm Treaty), this initiative is submitted, in consultation with the European Commission, in compliance with the provisions of the Treaty on European Union, with the aim of incorporating the substance of the provisions of the Prüm Treaty into the legal framework of the European Union.

– (PT) Mr President, Mr President-in-Office of the Council, Mr Frattini, ladies and gentlemen, I should like, if I may, to make a few brief personal observations on the Prüm Initiative, which Parliament is debating and scrutinising today and tomorrow, and on which I was rapporteur for the Committee on Civil Liberties, Justice and Home Affairs.

Les discussions portant sur l’initiative législative de l’Autriche relative à une décision du Conseil sur la coopération dans le cadre d ’ ATLAS (un réseau pour la coopération en matière de lutte antiterroriste) ont été suspendues car le Conseil estime que certains éléments sont déjà présents dans l’initiative transposant les éléments du Traité de Prüm non liés à Schengen et relevant du troisième pilier.
56. The discussion about the legislative initiative presented by Austria for a Council Decision pertaining to the ATLAS cooperation (a network for counter terrorism cooperation) has been suspended because Council considers that some elements are already present in the initiative transposing the non-Schengen related third pillar elements of the Treaty of Prüm.

Therefore he issues this opinion on his own initiative, in the same way as he issued opinions on the initiative for a Council Decision on the stepping up of cross-border cooperation, particularly in combating terrorism and cross-border crime (‘Prüm-Treaty’) and on the initiative for a Council Decision on the implementation of the former Council Decision (2).
