Ireland is taking part in this [instrument] in accordance with Article 5(1) of Protocol No 19 on the Schengen acquis integrated into the framework of the European Union, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, and Article 6(2) of Council Decision 2002/192/EC of 28 February 2002 concerning Ireland's request to take part in some of the provisions of the Schengen acquis*.

The United Kingdom is taking part in this [INSTRUMENT], in accordance with Article 5(1) of Protocol No 19 on the Schengen acquis integrated into the framework of the European Union, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis*.

4. La présente décision-cadre n'impose aucune obligation aux États membres de communiquer des informations ou des renseignements devant être utilisés comme preuves devant une autorité judiciaire et elle ne donne aucun droit d'utiliser ces informations ou renseignements à une telle fin.
4. This Framework Decision does not impose any obligation on the part of the Member States to provide information and intelligence to be used as evidence before a judicial authority nor does it give any right to use such information or intelligence for that purpose.

5. La présente décision-cadre n'impose aucune obligation d'obtenir les informations ou les renseignements par des mesures coercitives, définies conformément au droit national, dans l'État membre qui reçoit la demande d'informations ou de renseignements.
5. This Framework Decision does not impose any obligation to obtain any information or intelligence by means of coercive measures, defined in accordance with national law, in the Member State receiving the request for information or intelligence.

Sans préjudice de la décision-cadre 2002/584/JAI, les dispositions de la présente décision-cadre s’appliquent, mutatis mutandis dans la mesure où elles sont compatibles avec les dispositions de ladite décision-cadre, à l’exécution des condamnations dans les cas où un État membre s’engage à exécuter la condamnation conformément à l’article 4, point 6), de ladite décision-cadre ou lorsque, agissant dans le cadre de l’article 5, point 3), de cette même décision-cadre, il a imposé comme condition le renvoi de la personne dans l’État membre concerné afin d’y purger la peine, de manière à éviter l’impunité de la personne concernée.
Without prejudice to Framework Decision 2002/584/JHA, provisions of this Framework Decision shall apply, mutatis mutandis to the extent they are compatible with provisions under that Framework Decision, to enforcement of sentences in cases where a Member State undertakes to enforce the sentence in cases pursuant to Article 4(6) of that Framework Decision, or where, acting under Article 5(3) of that Framework Decision, it has imposed the condition that the person has to be returned to serve the sentence in the Member State concerned, so as to avoid impunity of the person concerned.

Dans la mesure où les dispositions qui figurent dans ces actes imposent aux États membres destinataires, en ce qui concerne l’utilisation ou le transfert ultérieur de données à caractère personnel, des conditions plus restrictives que celles figurant dans les dispositions correspondantes de la présente décision-cadre, les premières citées ne devraient pas s’en trouver affectées.
To the extent that the provisions of those acts imposing conditions on receiving Member States as to the use or further transfer of personal data are more restrictive than those contained in the corresponding provisions of this Framework Decision, the former provisions should remain unaffected.

En vertu de l'article 9 de cette décision-cadre, les États membres sont tenus d'adopter les mesures nécessaires pour se conformer aux dispositions de la présente décision-cadre le 12 mai 2006 et de communiquer au secrétariat général du Conseil et à la Commission le texte des dispositions transposant dans leur droit national les obligations que leur impose la présente décision-cadre.
Under Article 9 of the Framework Decision, Member States are to take the necessary measures to comply with the provisions of this Framework Decision by 12 May 2006 and transmit to the General Secretariat of the Council and to the Commission the text of the provisions transposing into their national law the obligations imposed on them under this Framework Decision.

De même, le respect de l'article 6, paragraphe 2 du traité sur l'Union européenne, ainsi que de la Charte des droits fondamentaux de l'Union européenne et, en particulier, de ses articles 1, 7, 8 et 47, impose une même interprétation quant au niveau de protection fixé par la présente décision-cadre au regard de celui fixé par ces deux conventions.
Similarly, in keeping with Article 6(2) of the Treaty on European Union and the Charter of Fundamental Rights of the European Union, with particular reference to Articles 1, 7, 8 and 47 thereof, the interpretation of the level of protection laid down by this Framework Decision must be the same as that laid down by those two Conventions.

(9) Les dispositions de la présente décision-cadre n'imposent, toutefois, pas aux États membres de garantir aux victimes un traitement équivalant à celui des parties aux procès.
(9) The provisions of this Framework Decision do not, however, impose an obligation on Member States to ensure that victims will be treated in a manner equivalent to that of a party to proceedings.

2. Les États membres communiquent, dans les mêmes délais, au Secrétariat général du Conseil et à la Commission le texte des dispositions transposant dans leur droit national les obligations que leur impose la présente décision-cadre.
2. By the same date Member States shall transmit to the General Secretariat of the Council and to the Commission the text of the provisions transposing into their national law the obligations imposed on them under this Framework Decision.

Le Conseil a en outre estimé que la présente décision-cadre, fondée sur l'article 34 du traité sur l'Union européenne, constituait un instrument approprié pour imposer aux États membres l'obligation de prévoir des sanctions pénales .
The Council also considered that the present Framework Decision, based on Article 34 TEU, is a correct instrument to impose on the member States the obligation to provide for criminal sanctions.
