The text of the Agreement is attached to Council Decision 2014/295/EU of 17 March 2014 on the signing, on behalf of the European Union, and provisional application of the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Ukraine, of the other part, as regards the Preamble, Article 1, and Titles I, II and VII thereof (2).

À la suite de la signature du préambule, de l'article 1 et des titres I, II et VII de l'accord lors du sommet entre l'Union et ses États membres, d'une part, et l'Ukraine, d'autre part, qui s'est tenu à Bruxelles le 21 mars 2014, il convient de signer les parties restantes de l'accord au nom de l'Union.
Following the signing of the Preamble, Article 1, and Titles I, II and VII of the Agreement at the Summit between the Union and its Member States, of the one part, and Ukraine of the other part, held in Brussels on 21 March 2014, the remaining parts of the Agreement should be signed on behalf of the Union.

La signature, au nom de l’Union, de l’accord d’association entre l’Union européenne et la Communauté européenne de l’énergie atomique et leurs États membres, d’une part, et l’Ukraine, d’autre part (ci-après dénommé «accord»), en ce qui concerne son préambule, son article 1 et ses titres I, II et VII est autorisée, sous réserve de la conclusion dudit accord et conformément à l’acte final.

The signing, on behalf of the Union, of the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Ukraine, of the other part (hereinafter referred to as ‘the Agreement’), as regards the Preamble, Article 1 and Titles I, II and VII thereof is hereby authorised, subject to the conclusion of the said Agreement and in accordance with the Final Act.

Le présent accord n’affecte pas les droits, obligations et responsabilités de la Communauté, des États membres et de l’Ukraine qui découlent du droit international et, en particulier, de toute convention internationale ou de tout accord auxquels ils sont parties, notamment ceux mentionnés dans le préambule.

This Agreement shall be without prejudice to the rights, obligations and responsibilities of the Community, the Member States and Ukraine arising from International Law and, in particular, from any applicable International Convention or agreement to which they are Parties, including those referred to in the Preamble.

(4) See in this context also the preamble of the Surveillance and Court Agreement, which clarifies that 'the objective of the Contracting Parties to the EEA Agreement, in full deference to the independence of the courts, to arrive at and maintain a uniform interpretation and application of the EEA Agreement and those provisions of the Community legislation which are substantially reproduced in that Agreement and to arrive at an equal treatment of individuals and economic operators as regards the four freedoms and the conditions of competition'.

En effet, alors que l’accord précédent disposait dans son préambule que «le présent accord ne déroge pas à la compétence qu’ont les autorités des États membres responsables de la protection des données de protéger les particuliers à l’égard du traitement de leurs données à caractère personnel», la proposition mentionne désormais «le contrôle des autorités compétentes chargées de la protection des données dans le respect des dispositions spécifiques du présent accord».
Indeed, while the previous agreement stated in its preamble that ‘this Agreement does not derogate from the existing powers of data protection authorities in Member States to protect individuals with regard to the processing of their personal data’, the proposal now refers to ‘the supervision of competent data protection authorities in a manner consistent with the specific provisions of this agreement’.
