(9) Conformément au protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne, le présent règlement constitue un développement de l'acquis de Schengen, tel que défini par l'annexe A de la décision 1999/435/CE du Conseil du 20 mai 1999 relative à la définition de l'acquis de Schengen en vue de déterminer, conformément aux dispositions pertinentes du traité instituant la Communauté européenne et du traité sur l'Union européenne, la base juridique de chacune des dispositions ou décisions qui constituent l'acquis.
(9) This Regulation constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.

(12) This instrument constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.

(34) L'Irlande participe à la présente décision conformément à l'article 5 du protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne annexé au traité UE et au traité CE et à l'article 6, paragraphe 2, de la décision 2002/192/CE du Conseil du 28 février 2002 relative à la demande de l'Irlande de participer à certaines dispositions de l'acquis de Schengen .
(34) Ireland is taking part in this Decision in accordance with Article 5 of the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the EU Treaty and to the EC Treaty, and Article 6(2) of Council Decision 2002/192/EC of 28 February 2002 concerning Ireland's request to take part in some of the provisions of the Schengen acquis .

(33) Le Royaume-Uni participe à la présente décision conformément à l'article 5 du protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne annexé au traité UE et au traité CE et à l'article 8, paragraphe 2, de la décision 2000/365/CE du Conseil du 29 mai 2000 relative à la demande du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord de participer à certaines dispositions de l'acquis de Schengen .
(33) The United Kingdom is taking part in this Decision, in accordance with Article 5 of the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the EU Treaty and to the EC Treaty, and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000, concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis .

Le Royaume-Uni participe à la présente décision, conformément à l'article 5 du protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne et à l'article 8, paragraphe 2, de la décision 2000/365/CE du Conseil du 29 mai 2000 relative à la demande du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord de participer à certaines dispositions de l'acquis de Schengen (10), pour autant que ses mesures développent les dispositions de l'acquis de Schengen afin de lutter contre l'organisation de l'immigration illégale auxquelles le Royaume-Uni participe, et conformément à l'article 3 du protocole sur la position du Royaume-Uni et de l'Irlande annexé au traité sur l'Union européenne et au traité instituant la Communauté européenne, ayant notifié son souhait de participer à l'adoption et à l'application de la présente décision.
The United Kingdom is taking part in this Decision, in accordance with Article 5 of the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the Treaty on European Union and to the Treaty establishing the European Community and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis (10), to the extent that its measures develop provisions of the Schengen acquis against the organisation of illegal immigration in which the United Kingdom participates, and the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, having notified under Article 3 thereof its wish to take part in the adoption and application of this Decision.

Under Article 6 of the protocol integrating the Schengen acquis into the framework of the European Union (Schengen protocol), Norway and Iceland are also associated with the implementation and further development of the Schengen acquis.

Conformément aux articles 4 et 5 du protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne, «l'Irlande et le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord, qui n'ont pas souscrit à l'acquis de Schengen, peuvent à tout moment demander de participer à tout ou partie des dispositions de cet acquis».
According to Article 4 and 5 of the Protocol integrating the Schengen acquis into the framework of the European Union, “Ireland and the United Kingdom of Great Britain and Northern Ireland, which are not bound by the Schengen acquis, may at any time request to take part in some or all of the provisions of the acquis”.

[7] L'article 8 du Protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne dispose que "l'acquis de Schengen et les autres mesures prises par les institutions dans le champ d'application de celui-ci sont considérés comme un acquis qui doit être intégralement accepté par tous les Etats candidats à l'adhésion".
[7] Article 8 of the Protocol incorporating the Schengen acquis in the European Union provides that "the Schengen acquis and further measures taken by the institutions within its scope shall be regarded as an acquis which must be accepted in full by all States candidates for admission".

(2 bis) La République d'Islande et le Royaume de Norvège devraient être associés à la mise en œuvre de l'acquis de Schengen et à la poursuite de son développement, conformément à l'article 6 du protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne, protocole annexé au traité sur l'Union européenne et au traité instituant la Communauté européenne.
(2a) The Republic of Iceland and the Kingdom of Norway should be associated with the implementation of the Schengen acquis and its further development, pursuant to Article 6 of the Protocol integrating the Schengen acquis into the framework of the European Union, Protocol annexed to the Treaty on European Union and to the Treaty establishing the European Community.
