At such time as the Community notifies the Agency in accordance with Section 1(C) of Protocol 1 of this Agreement that there is nuclear material in peaceful nuclear activities in French Protocol I territories in quantities that exceed the limits referred to in Section 1(A)(1) of Protocol 1 of this Agreement or that the decision has been taken to construct or authorize construction of a facility, as defined in the Definitions, in French Protocol I territories, as referred to in Section 1(A)(2) of Protocol 1 of this Agreement, whichever occurs first, a Protocol for procedures for cooperation in the application of the safeguards provided for under the Agreement shall be agreed upon between France, the Community and the Agency.

L. whereas a Memorandum of Understanding (MoU) is, by definition, an agreement between the Member State concerned and the Troika, which results from negotiations and by which a Member State undertakes to carry out a number of precise actions in exchange for financial assistance; whereas the Commission signs the MoU on behalf of euro area finance ministers; whereas, however, it is not public knowledge how negotiations have been conducted in practice between the Troika and the relevant Member State and, furthermore, there is a lack of transparency as to the extent to which a Member State seeking assistance has been able to influence the outcome of negotiations; whereas it is stipulated in the ESM Treaty that a Member State requesting assistance from the ESM is expected to address, wherever possible, a request for assistance to the IMF;

(13) Il convient de conférer à la Commission le pouvoir d'adopter des actes conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne, afin de mettre à jour les définitions figurant dans la présente décision sur la base des modifications des définitions adoptées par les organes de la CCNUCC ou du protocole de Kyoto ou en vertu d'autres accords multilatéraux relatifs au changement climatique conclus par l'Union, afin de modifier l'annexe I pour ajouter des périodes comptables et assurer la concordance entre ces périodes comptables et les périodes correspondantes adoptées par les organes de la CCNUCC ou dans le cadre d'autres accords multilatéraux en rapport avec le changement climatique conclus par l'Union, afin de modifier l'annexe II pour actualiser les niveaux de référence conformément aux niveaux de référence proposés par les États membres sous réserve des corrections apportées conformément à la présente décision, et à la lumière des changements apportés aux niveaux de référence adoptés par les organes de la CCNUCC ou du protocole de Kyoto ou d'autres cadres appelés à leur succéder, afin de réviser les informations indiquées à l'annexe III en fonction du progrès scientifique, de revoir les conditions concernant les règles comptables applicables pour les perturbations naturelles prévues par la présente décision, à la lumière du progrès scientifique ou de tenir compte des révisions d'actes adoptés par les organes de la CCNUCC ou du protocole de Kyoto.
(13) The power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission to update the definitions laid down in this Decision in the light of changes to definitions adopted by the bodies of the UNFCCC or the Kyoto Protocol or other multilateral agreements relevant to climate change concluded by the Union, to amend Annex I to add accounting periods and ensure consistency between those accounting periods and the relevant periods adopted by the bodies of the UNFCCC, or other multilateral agreement relevant to climate change concluded by the Union, to amend Annex II with updated reference levels in accordance with the proposed reference levels submitted by Member States subject to corrections made in accordance with this Decision and in the light of changes to reference levels approved by the bodies of the UNFCCC or the Kyoto Protocol, to revise the information specified in Annex III in accordance with scientific progress and in the light of changes adopted by the bodies of the UNFCCC or the Kyoto Protocol or other successor frameworks and to revise the conditions relating to the accounting rules for natural disturbances laid down in this Decision in the light of scientific progress or to reflect revisions to acts adopted by the UNFCCC or Kyoto Protocol bodies.

(13 quater) Il convient d'établir certaines procédures relatives à l'application de l'article 14 (ristourne ou exonération des droits de douane) du protocole concernant la définition de «produits originaires» et les méthodes de coopération administrative annexé à l'accord (ci-après dénommé «protocole sur les règles d'origine») afin de garantir le bon fonctionnement des mécanismes qui y sont prévus et de permettre des échanges complets d'informations avec les parties prenantes concernées.
(13c) It is necessary to lay down certain procedures relating to the application of Article 14 (Drawback of, or exemption from, customs duties) of the Protocol concerning the definition of ‘originating products’ and methods of administrative co-operation of the Agreement (hereinafter the ‘Rules of Origin Protocol’) in order to ensure the effective operation of the mechanisms provided for therein and to provide for a comprehensive exchange of information with relevant stakeholders.

L’annexe V de l’accord de partenariat entre les membres du groupe des États d’Afrique, des Caraïbes et du Pacifique, d’une part, et la Communauté européenne et ses États membres, d’autre part, signé à Cotonou le 23 juin 2000 (1) («accord de partenariat ACP-CE») et ses protocoles, notamment le protocole no 1 relatif à la définition de la notion de «produits originaires» et aux méthodes de coopération administrative, ont expiré le 31 décembre 2007 conformément à l’article 37, paragraphe 1, dudit accord.

CONSIDERING THAT The Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Republic of Tunisia, of the other part, hereinafter referred to as ‘the Euro-Mediterranean Agreement’ was signed in Brussels on 17 July 1995, entered into force on 1 March 1998 and was amended notably by the Protocol to the Euro-Mediterranean Agreement establishing an association between the European Community and its Member States, of the one part, and the Republic of Tunisia, of the other part, to take account of the accession of the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic to the European Union (1) and by Decision No 1/2006 of the EU-Tunisia Association Council of 28 July 2006 amending Protocol 4 to the Euro-Mediterranean Agreement concerning the definition of the concept of originating products and methods of administrative cooperation (2);
