Le protocole no 3 à l'accord de stabilisation et d'association entre les Communautés européennes et leurs États membres, d'une part, et la République du Monténégro, d'autre part (1) (ci-après dénommé «l'accord»), concerne la définition de la notion de «produits originaires» et les méthodes de coopération administrative (ci-après dénommé le «protocole no 3»).

L'Union a adhéré aux instruments suivants, qui établissent des organisations régionales, dont les activités sont également couvertes par les objectifs de l'Agence: la convention sur la protection de l'environnement marin de la zone de la mer Baltique (convention d'Helsinki révisée de 1992) (10); la convention pour la protection de la mer Méditerranée contre la pollution (convention de Barcelone) (11) et sa révision de 1995 (12) et un certain nombre de ses protocoles; l'accord concernant la coopération en matière de lutte contre la pollution de la mer du Nord par les hydrocarbures et autres substances dangereuses (accord de Bonn) (13); la convention pour la protection du milieu marin de l'Atlantique du Nord-Est (convention OSPAR) (14); l'accord de coopération pour la protection des côtes et des eaux de l'Atlantique du Nord-Est contre la pollution, signé le 17 octobre 1990 (accord de Lisbonne) (15), ainsi que son protocole additionnel, signé le 20 mai 2008, qui ne sont pas encore entrés en vigueur (16).
The Union has acceded to the following instruments, establishing regional organisations, whose activities are also covered by the Agency’s objectives: the Convention on the Protection of the Marine Environment of the Baltic Sea Area (Helsinki Convention as revised in 1992) (10); the Convention for the Protection of the Mediterranean Sea against Pollution (Barcelona Convention) (11), and its 1995 revision (12) and to a number of protocols thereto; the Agreement for cooperation in dealing with pollution of the North Sea by oil and other harmful substances (Bonn Agreement) (13); the Convention for the protection of the marine environment of the North-East Atlantic (OSPAR Convention) (14); the Cooperation Agreement for the protection of the coasts and waters of the north-east Atlantic against pollution, signed on 17 October 1990 (Lisbon Agreement) (15), with the Additional Protocol thereto, signed on 20 May 2008, which have not yet entered into force (16).

(23) À la lumière de la mise en place du SEAE et suite à l'entrée en vigueur de la présente décision, la Commission et la BEI devraient modifier le protocole d'accord concernant la coopération et la coordination dans les régions visées par la décision 2006/1016/CE du Conseil du 19 décembre 2006 accordant une garantie communautaire à la Banque européenne d'investissement en cas de pertes résultant de prêts et de garanties de prêts en faveur de projets en dehors de la Communauté , et, selon le cas et avec l'accord du Haut représentant, étendre le nouveau protocole d'accord au SEAE, en particulier en ce qui concerne le dialogue régulier et systématique entre la BEI et la Commission au niveau stratégique, qui devrait inclure aussi le SEAE, et d'autres aspects qui relèvent des compétences du SEAE.
(23) In light of the creation of the EEAS and following the entry into force of this Decision, the Commission and the EIB should amend the Memorandum of Understanding on cooperation and coordination in the regions referred to in Council Decision 2006/1016/EC of 19 December 2006 granting a Community guarantee to the European Investment Bank against losses under loans and loan guarantees for projects outside the Community , and, as appropriate and with the approval of the High Representative, extend the new Memorandum of Understanding to the EEAS, in particular as regards the regular and systematic dialogue between the EIB and the Commission at the strategic level, which should also include the EEAS, and other aspects within the competence of the EEAS.

(14 ter) Suite à la mise en place du SEAE et à l'entrée en vigueur de cette décision, la Commission et la BEI devraient modifier le Protocole d'accord concernant la coopération et la coordination dans les régions visées par la décision 2006/1016/CE du Conseil accordant une garantie communautaire à la Banque européenne d'investissement en cas de pertes résultant de prêts et de garanties de prêts en faveur de projets en dehors de la Communauté, et, selon le cas et avec l'accord du Haut Représentant, étendre le nouveau protocole d'accord au SEAE, en particulier en ce qui concerne le dialogue régulier et systématique entre la BEI et la Commission au niveau stratégique, qui devrait inclure aussi le SEAE, et d'autres aspects qui relèvent des compétences du SEAE.

Les modifications apportées à l'accord par le protocole additionnel concernent uniquement l'inclusion de la Bulgarie et de la Roumanie dans certains articles concernant des dispositions institutionnelles et l'inclusion des langues bulgare et roumaine aux fins de l'accord, c'est-à-dire que la déclaration sur facture est également valide en bulgare et en roumain.
The modifications made to the agreement through the Additional Protocol only concern the inclusion of Bulgaria and Romania to some Articles on institutional provisions and the inclusion of the Bulgarian and Romanian languages for the purpose of the agreement, e.g. that the invoice declaration is also valid in Bulgarian and Romanian.

Si l’accord entre l’Union européenne, la Communauté européenne et la Confédération suisse concernant l’association de la Confédération suisse à la mise en œuvre, à l’application et au développement de l’acquis de Schengen et les protocoles annexés à cet accord concernant le Liechtenstein sont entrés en vigueur au moment de la conclusion des négociations avec la République du Monténégro, une déclaration analogue sera ajoutée pour la Suisse et le Liechtenstein.
If the Agreement between the EU, the EC and the Swiss Confederation concerning the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis and the Protocols to this Agreement concerning Liechtenstein has entered into force by the time negotiations with the Republic of Montenegro have concluded, a similar declaration will also be made in respect of Switzerland and Liechtenstein.
