Thus the Parliament requested for example that the Commission should present by the end of 2001 a proposal to revise the Europol Convention following best practices and methods of democratic control of police services in the Member States: "A proposal for the comprehensive reform of the instruments of police and judicial cooperation, including revision of the Europol Convention to bring it into line with higher standards and methodes of democratic control of the police forces of the Member States is to be submitted by the Commission by the end of 2001; that comprehensive reform should aim gradually to communitise those instruments, to strengthen judicial control by the Court of Justice and to fund those instruments through the Community budget". [13]

At the European Council’s request, the Commission presented in 2005 a proposal for an instrument regulating the exchange of information under the principle of availability.[34] Instead of endorsing this proposal, the Council adopted in 2006 the Swedish initiative , which streamlines the sharing between Member States of any existing information or criminal intelligence that might be necessary for a criminal investigation or criminal intelligence operation.[35] This instrument is rooted in the policy principle of ‘equivalent access,’ according to which the conditions applicable to cross-border data exchange should be no stricter than those regulating domestic access.

In this opinion, he underlined the importance of the proposal as an effective instrument for the protection of personal data in the area covered by Title VI of the EU-Treaty. Such an instrument should not only respect the principles of data protection as laid down in the Council of Europe Convention No 108 (4) and more specifically in directive 95/46/EC, but also provide for an additional set of rules taking into account the specific nature of the area of law enforcement.
