IN-CONTEXT TRANSLATIONS

Le comité responsable des orientations relatives aux réseaux transeuropéens dans le secteur de l'énergie s'est réuni le 7 avril pour examiner l'échange d'informations concernant l'avancement des projets d'intérêt commun (doc. n° 2000/1 du comité sur les RTE-Énergie), le projet de décision de la Commission définissant les cahiers des charges des projets d'intérêt commun (doc. n° 2000/2 du comité RTE-Énergie), un projet de rapport de la Commission sur la mise en oeuvre des orientations relatives aux réseaux transeuropéens d'énergie (doc. n° 2000/3 du comité sur les RTE-Énergie), ainsi que les modifications potentielles futures de ces orientations et les nouveaux projets à inclure dans la liste des projets d'intérêt commun).
The TEN-Energy Guidelines Committee met on 7 April to discuss the exchange of information on the progress of the projects of common interest (Doc. Committee on TEN- Energy N° 2000/1); the draft Commission Decision defining the specification of the projects of common interest (Doc. Committee on TEN-Energy N° 2000/2); and a draft report of the Commission on the implementation of the TEN-Energy Guidelines (Doc. Committee on TEN-Energy N° 2000/3), on possible future modifications to those Guidelines, and on new projects to be included in the list of projects of common interest.

6. L’ABE élabore des projets de normes techniques de réglementation précisant le cadre de la coopération et de l’échange d’informations entre les autorités compétentes de l’État membre d’origine et les autorités compétentes de l’État membre d’accueil conformément au présent titre et le cadre permettant de vérifier le respect des dispositions de droit national transposant les titres III et IV. Ces projets de normes techniques de réglementation précisent la méthode, les moyens et les modalités détaillées applicables à la surveillance des établissements de paiement exerçant leurs activités sur une base transfrontalière, et en particulier le périmètre et le traitement des informations à échanger, afin de garantir une surveillance cohérente et efficace des établissements de paiement qui fournissent des services de paiement sur une base transfrontalière.
6. EBA shall develop draft regulatory technical standards specifying the framework for cooperation, and for the exchange of information, between the competent authorities of the home Member State and of the host Member State in accordance with this Title and to monitor compliance with the provisions of national law transposing Titles III and IV. The draft regulatory technical standards shall specify the method, means and details of cooperation in the supervision of payment institutions operating on a cross-border basis and, in particular, the scope and treatment of information to be exchanged, to ensure consistent and efficient supervision of payment institutions exercising cross-border provision of payment services.

4. Afin d'uniformiser les modalités d'application pour la coordination et l'échange d'informations entre les autorités de contrôle, l'AEAPP élabore des projets de normes techniques d'exécution pour préciser les procédures et modèles pour la transmission d'informations au contrôleur du groupe ainsi que la procédure de coopération et d'échange d'informations entre autorités de contrôle prévus au présent article.
4. In order to ensure uniform conditions of application in relation to the coordination and exchange of information between supervisory authorities, EIOPA shall develop draft implementing technical standards on the procedures and templates for the submission of information to the group supervisor as well as the procedure for the cooperation and the exchange of information between supervisory authorities as laid down in this Article.

En vue d'améliorer les échanges d'informations entre les États membres sur les casiers judiciaires, les projets mis au point dans le but de réaliser cet objectif, notamment le projet actuel d'interconnexion des casiers judiciaires nationaux, sont les bienvenus.
With a view to improving the exchange of information between Member States on criminal records, projects developed with the aim to achieve this objective are welcomed, including the existing project for the interconnection of national criminal registers.

Les domaines couverts sont, entre autres: l’extension des contrôles de manière à couvrir le transit, le transbordement[2], le courtage et les réexportations; la clarification du contenu des contrôles des transferts intangibles de technologie; l’établissement d’une procédure de «comitologie» pour l’adoption des listes des biens soumis à contrôle; l’amélioration des échanges d’information sur les contrôles nationaux concernant des biens non listés conformément à des normes de sécurité appropriées; l’amélioration des échanges d’information sur les refus avec la possibilité d’introduire un système électronique fiable entre la Commission, les États membres et le Conseil; la coopération internationale avec les pays tiers, avec la possibilité d’adopter des règles de contrôle ad hoc des exportations dans le cas de projets spécifiques financés par la Communauté et impliquant un accès potentiel aux technologies communautaires à double usage par des pays tiers; l’insertion, à l'article 21 refondu, d’une référence à des sanctions pénales au moins pour les violations graves des dispositions du règlement et des réglementations adoptées par les États membres pour sa mise en œuvre, afin de répondre à l'appel lancé dans la déclaration du Conseil européen sur les sanctions pénales de juin 2004, et à l’appel de la résolution 1540 du Conseil de sécurité des Nations unies concernant l’introduction de sanctions civiles ou pénales appropriées en cas de violation des réglementations sur le contrôle des exportations; le remplacement des contrôles intracommunautaires restants par un système basé sur une notification préalable des expéditions; des dispositions relatives à la fixation par les autorités nationales de délais indicatifs pour la gestion des demandes d’autorisation d'exportation et de délais pour le traitement des demandes d’information auprès des autorités compétentes en ce qui concerne l’application des contrôles nationaux sur des biens et technologies non listés.
The areas covered are, among others: the extension of controls to cover transit, transhipment[2], brokering and re-exports; the clarification of the content of controls of intangible transfers of technology; the establishment of a comitology procedure for the adoption of lists of controlled items; the improvement of sharing of information on national controls on non-listed items according appropriate security standards; the improvement of sharing of information on denials with the possibility to introduce a secure electronic system between the Commission, Member States and the Council; international cooperation with third countries, providing for possibilities of adopting ad-hoc export control rules in the case of specific EC-funded projects involving potential access by third countries to the EU dual use technologies; insertion in the recasted Article 21 of the reference to criminal sanctions at least for serious infringements of the provisions of the Regulation and of the regulations adopted by Member States for its implementation so as to respond to the call in the European Council declaration on criminal sanctions of June 2004, and to the call by UN Security Council Resolution 1540 for the introduction of appropriate civil or criminal penalties for violations of such export control regulations; the replacement of the remaining intra-Community controls by a system consisting of prior-notification of shipments; provision for the establishment by national authorities of indicative deadlines for the processing of applications for export authorisations, and of deadlines for the treatment of requests for information from licensing authorities concerning the application of national controls on non listed items and technologies.
