In order to ensure uniform conditions for the implementation of this Directive implementing powers should be conferred on the Commission concerning the laying down and updating of a priority list of additives for enhanced reporting, the laying down and updating of the format for the reporting of ingredients and for the dissemination of that information, determining whether a tobacco product has a characterising flavour or has increased levels of toxicity, addictiveness or CMR properties, the methodology for determining whether a tobacco product has a characterising flavour, the procedures for the establishment and operation of an independent advisory panel for determining tobacco products with characterising flavours, the precise position of health warnings on pouches of roll-your-own tobacco, the technical specifications for the layout, design, and shape of combined health warnings, the technical standards for the establishment and operation of the tracking and tracing system, for ensuring the compatibility of the systems for the unique identifiers and for the security features, as well as establishing a common format for notification of electronic cigarettes and refill containers and the technical standards for the refill mechanisms for such products.

4. Afin d'assurer l'uniformité des modalités d'application du présent article et de faciliter le calcul du module “risque de souscription en santé” visé à l'article 105, paragraphe 4, l'AEAPP élabore des projets de normes techniques d'exécution, tenant compte des calculs effectués par les autorités de surveillance des États membres concernés, précisant les écarts types relatifs aux mesures législatives nationales spécifiques d'États membres qui autorisent la répartition des remboursements en matière de risque de santé entre entreprises d'assurance et de réassurance et qui respectent les critères du paragraphe 5 ainsi que tous les critères supplémentaires établis par les actes délégués.

In order to ensure uniform conditions of application of this Article and for the purpose of facilitating the calculation of the health underwriting risk module referred to in Article 105(4), EIOPA shall develop draft implementing technical standards, taking into account the calculations provided by the supervisory authorities of the Member States concerned, on standard deviations in relation to specific national legislative measures of Member States which permit the sharing of claims payments in respect of health risk amongst insurance and reinsurance undertakings and which meet the criteria in paragraph 5 and any additional criteria established by delegated acts.
