Au moment de conclure l’accord intergouvernemental ou la modification d'accord en projet, ils devront tenir pleinement compte de l’avis de la Commission.
When concluding the proposed intergovernmental agreement or amendment, Member States will have to take full account of the Commission's opinion.

2.Dès que les parties sont parvenues à un accord global sur les principaux éléments d’un projet d’accord intergouvernemental ou de modification d’un accord intergouvernemental existant, mais avant la clôture des négociations officielles, l’État membre concerné notifie à la Commission ledit projet d’accord ou de modification avec ses annexes éventuelles en vue d'une évaluation ex ante conformément à l’article 5.
2.As soon as an agreement has been reached by the parties on all the main elements of a draft intergovernmental agreement or an amendment to an existing intergovernmental agreement, but before the closure of formal negotiations, the Member State concerned shall notify to the Commission this draft agreement or amendment together with any annexes thereto for ex-ante assessment in accordance with Article 5.

1.La Commission informe l'État membre concerné, dans un délai de six semaines à compter de la date de notification du projet complet d'accord intergouvernemental ou de modification, y compris leurs annexes, conformément à l'article 3, paragraphe 2, de ses doutes éventuels quant à la compatibilité du projet d'accord intergouvernemental ou de modification avec le droit de l'Union, en particulier avec la législation relative au marché intérieur de l’énergie et le droit de la concurrence de l’Union.
1.The Commission shall, within six weeks of the date of notification of the complete draft intergovernmental agreement or amendment, including annexes thereto, pursuant to Article 3(2), inform the Member State concerned of any doubts it may have as to the compatibility of the draft intergovernmental agreement or amendment with Union law, in particular with internal energy market legislation and Union competition law.

Where a Member State is negotiating an intergovernmental agreement or an amendment to an existing intergovernmental agreement and it has been unable, on the basis of its own assessment, to reach a firm conclusion as to the compatibility of the intergovernmental agreement or amendment under negotiation with Union law, it shall inform the Commission thereof before the closure of the negotiations and submit the draft agreement or amendment together with any annexes to it.
