B. whereas, although public-private partnerships (PPPs) are a long-term tool used in government policies at international, national, regional and local level, there is no internationally recognised definition and comprehensive regulatory framework for them; whereas in practice PPPs are understood to refer to a ‘broad and varied spectrum of cooperative relationships between public actors (governments, agencies, and international organisations, or a combination thereof) and private actors (companies or not-for-profit entities)’ and usually imply supply by the private sector of infrastructure or assets traditionally provided by governments;

Ce cadre stratégique se reflète dans la programmation de l’aide au développement de l’UE de 2014 à 2020 pour ce qui est des stratégies de développement du secteur privé national et régional, comme le travail conjoint ACP-UE sur un nouveau cadre de coopération pour le développement du secteur privé dans les pays ACP, au niveau des programmes thématiques qui abordent la participation du secteur privé en tant que question transversale, et dans les interventions sectorielles qui visent à intégrer la coopération avec le secteur privé dans l’agriculture, l’énergie durable, les infrastructures, le secteur de l'économie verte et le secteur social.
This strategic framework is being reflected in the programming of EU development assistance from 2014 to 2020 with regard to national and regional private sector development strategies such as the joint ACP-EU work on a new cooperation framework for private sector development in ACP countries, at the level of thematic programmes that address private sector engagement as a cross-cutting issue, and in sectoral interventions designed to mainstream engagement with the private sector in agriculture, sustainable energy, and infrastructure, or in green and social sectors.

[7] To ensure that infrastructure and project investments supported under this initiative are consistent with state aid rules, projects should address unmet needs (e.g. not duplicate existing infrastructure), crowd in private financing to the maximum extent possible and avoid crowding out privately financed projects.

– Ensuring sustainable and accessible urban mobility: innovative organisation schemes, including clean and safe vehicles and means of transport with lower levels of pollution , including those based on hydrogen and fuel cells, improving accessibility for persons with reduced mobility , improved and innovative solutions for transport vehicles and infrastructure - making them accessible to disabled persons, new public and/or collective transportation modes with a focus on efficiency throughout the entire mobility chain (public/collective transport, carsharing or pooling, walking and cycling) and rationalisation of private transport, communication infrastructure, integrated town planning, street works and transport incorporating modal shifts for freight traffic in line with environmental considerations; affordable schemes, balancing hardware and infrastructure measures with mobility management measures; management tools; smart software for integrated air quality, noise and traffic modelling; improving mobility between cities and their outer regions; mobility management and behavioural change measures .

Moreover, according to the case-law, although Member States have wide discretion to define what they regard as services of general economic interest, the definition of such services or tasks by a Member State can be questioned by the Commission in the event of a manifest error . In other words, although the determination of the nature and scope of an SGEI mission falls within the competence and discretionary powers of Member States, such competence is neither unlimited nor can it be exercised arbitrarily . In particular, for an activity to be considered as an SGEI, it should exhibit special characteristics as compared with ordinary economic activities . In this respect, the Commission will consider that in areas where private investors have already invested in a broadband network infrastructure (or are in the process of expanding further their network infrastructure) and are already providing competitive broadband services with an adequate broadband coverage, setting up a parallel competitive and publicly-funded broadband infrastructure should not be considered as an SGEI within the meaning of Article 86 of the Treaty . Where however it can be demonstrated that private investors may not be in a position to provide in the near future adequate broadband coverage to all citizens or users leaving thus a significant part of the population unconnected, a public service compensation may be granted to an undertaking entrusted with the operation of an SGEI provided that the conditions set out in paragraphs 25 to 29 are met.
