At the coordinators' meeting of 20 June 2011, Mr Rapkay made it known that he had received a message from Mr Uspaskich informing him that he had decided to withdraw his claim against the European Parliament in the General Court for the following reason:

6. observe que dans l'une des affaires mentionnées au paragraphe 5, le Tribunal de la fonction publique de l'Union européenne a tranché en faveur du requérant (affaire F-58/10, arrêt du 18 septembre 2012), a annulé la décision de l'Agence du 16 octobre 2009 de ne pas engager de procédures disciplinaires contre deux membres du personnel pour une allégation de harcèlement moral en raison de l'absence d'impartialité de la part de l'enquêteur et du refus de celui-ci de préserver l'anonymat des témoins, et lui a enjoint de verser des dommages et intérêts au requérant et de supporter les dépens; relève que, dans l'affaire F-112/10, le Tribunal de la fonction publique a tranché en faveur de l'Agence mais la partie requérante a formé un pourvoi contre l'arrêt devant le Tribunal; fait observer que le jugement est en attente dans l'affaire F-38/12;

Notes that in one of the cases referred to in paragraph 5, the European Union Civil Service Tribunal decided in favour of the applicant (Case F-58/10, judgment of 18 September 2012) and annulled the Agency's decision of 16 October 2009 not to bring disciplinary proceedings against two members of staff for alleged psychological harassment due to the lack of impartiality on the part of the investigator and his refusal to guarantee the anonymity of the witnesses and ordered it to pay damages to the applicant and the costs; notes that in case F-112/10, the Tribunal decided in favour of the Agency but the applicant brought an appeal before the General Court against the judgment; notes that judgement is pending in case F-38/12;
