It cannot be accepted that any decision of the administration, whether explicit or implied, containing either an inadequate statement of reasons or no statement of reasons (and thus necessitating a substantive examination) would be liable at any moment to become the subject of a request for an additional statement of reasons enabling officials or staff members to set themselves a new time-limit for lodging a complaint by claiming that they have three months from the receipt of that additional statement of reasons to lodge that complaint, even though the fact that a decision as referred to in Article 90(1) of the Staff Regulations contains an inadequate statement of reasons may — indeed must — be raised specifically in a complaint and thus be duly rectified, where necessary, by the administration in the decision ruling on that complaint.

(A) Whereas this application is based on Article 2 (a) of the European Globalisation Adjustment Fund Regulation (EC) No 1927/2006 and targets to support 1 000 workers of the total of 1 513 workers dismissed in the enterprise SC Mechel Campia Turzii SA and one downstream producer SC Mechel Reparatii Targoviste SRL within the reference period between 20 June 2012 and 20 October 2012;

(A) la demande à l'examen se fonde sur l'article 4, paragraphe 1, point b), du règlement (UE) nº 1309/2013 relatif au Fonds européen d'ajustement à la mondialisation et concerne 1 603 travailleurs licenciés dans 69 entreprises qui opèrent dans le secteur économique classé dans la division 62 ("Programmation, conseil et autres activités informatiques") de la NACE Rév. 2; les licenciements effectués par les entreprises concernées ont eu lieu dans les régions de niveau NUTS 2 de Länsi-Suomi, Helsinki-Uusimaa, Etelä-Suomi et Pohjois- ja Itä-Suomi pendant la période de référence comprise entre le 30 juillet 2014 et le 30 avril 2015;
(A) Whereas this application is based on Article 4(1)(b) of the European Globalisation Adjustment Fund Regulation (EC) No 1309/2013 and relates to 1603 workers dismissed in 69 enterprises operating in the economic sector classified under the NACE Revision 2 Division 62 (Computer programming, consultancy and related activities); whereas the redundancies made by the enterprises concerned are located NUTS level 2 regions of Länsi-Suomi, Helsinki-Uusimaa, Etelä-Suomi and Pohjois- ja Itä-Suomi within the reference period between 30 July 2014 and 30 April 2015;

1. prend acte de la diminution du nombre et de l'impact financier des irrégularités détectées lors de l'examen des fonds de pré-adhésion présentés dans le rapport de 2011; se félicite du fait que le taux de recouvrement des ressources de l'UE indûment versées dans le cadre de l'aide de pré-adhésion a substantiellement augmenté, mais note qu'il n'atteint toujours que 60 %; admet parallèlement que des disparités significatives subsistent entre les bénéficiaires en termes d'irrégularités signalées, dont le nombre varie principalement selon le stade d'adoption et de mise en œuvre du système de gestion des irrégularités (IMS); invite donc la Commission à poursuivre attentivement son suivi de la mise en œuvre de l'IMS dans tous les pays bénéficiant de cet instrument; appuie la demande de la Commission, en particulier à l'égard de la Croatie, en faveur d'une mise en œuvre pleine et entière du système IMS, demande qui nécessite toujours d'être traitée, bien que la formation et l'aide aient été assurées, ainsi que sa demande faite à l'ancienne République yougoslave de Macédoine de mettre en œuvre ledit système;

Takes note of the decrease in the number and the financial impact of irregularities detected with regard to the pre-accession funds examined in the 2011 report; welcomes the fact that the rate of recovery of EU resources unduly paid as part of pre-accession assistance has improved significantly, but notes that it still reaches only 60 %; acknowledges, at the same time, that significant differences exist among beneficiaries in terms of the irregularities reported, being mainly a measure of the stage of adoption and implementation of the Irregularity Management System (IMS); calls, therefore, on the Commission to continue to monitor closely the implementation of the IMS in all countries benefiting from the instrument; supports the Commission’s call for Croatia, in particular, fully to implement the IMS system, a call that has yet to be acted upon even though training and support have been provided, and its call for the Former Yugoslav Republic of Macedonia to implement the system;
