TRADUCTIONS EN CONTEXTE

L’article 50, paragraphe 1, du règlement no 1013/2006, tel que modifié par le règlement (CE) no 669/2008, selon lequel les sanctions appliquées par les États membres en cas d’infraction aux dispositions de ce règlement doivent être proportionnées, doit être interprété en ce sens que l’imposition d’une amende sanctionnant le transfert de déchets, tels que ceux visés à l’annexe IV dudit règlement, dans le pays de transit par un point de passage frontalier différent de celui indiqué sur le document de notification ayant fait l’objet d’un consentement des autorités compétentes, dont le montant de base correspond à celui de l’amende appliquée en cas de violation de l’obligation d’obtenir un consentement et d’effectuer une notification écrite préalable, ne saurait être considérée comme proportionnée que si les circonstances caractérisant l’infraction commise permettent de constater qu’il s’agit d’infractions de gravité équivalente.
Article 50(1) of Regulation No 1013/2006, as amended by Regulation (EC) No 669/2008, according to which the penalties applied by the Member States for infringement of the provisions of that regulation must be proportionate, must be interpreted as meaning that the imposition of a fine penalising the illegal shipment of waste, such as that referred to in Annex IV to that regulation, in the country of transit at a border crossing point which differs from that provided in the notification document which had been consented to by the competent authorities, of which the basic amount is the same as the fine imposed for a breach of the requirement to obtain consent and to give prior notification in writing, is to be considered to be proportionate only if the circumstances of the infringement make it possible to find that they involve equally serious infringements.

L’absence de jugement dans un délai raisonnable a causé à la partie requérante trois types de préjudices entre le 12 février 2010 et le 27 septembre 2012: 1) frais de garantie majorés pour le montant de l’amende que la partie requérante n’a pas immédiatement payé à la Commission à la suite de l’adoption de la décision C(2007) 5791 final, du 28 novembre 2007, dans l’affaire COMP/39165 — Verre plat; 2) coûts d’opportunité parce que le faible taux d’intérêt sur le montant d’amende tardivement restitué à la partie requérante à la suite de l’arrêt de la Cour de 2014 était très inférieur au rendement potentiel que la partie requérante aurait pu obtenir si, au lieu de verser cet argent à la Commission en 2008, elle l’avait investi dans ses activités, et 3) préjudice non financier dû au fait que la décision avait erronément imposé l’amende la plus élevée à la partie requérante en 2007 et au fait que, le Tribunal n’ayant pas statué dans un délai raisonnable, cette erreur n’a été rectifiée que tardivement par la Cour en novembre 2014.
The failure to rule within a reasonable time period caused the applicant three types of loss between 12 February 2010 and 27 September 2012: (1) increased costs related to a bank guarantee for the amount of the fine that the applicant did not immediately pay to the Commission following the adoption of decision No C(2007)5791 final of 28 November 2007 in Case COMP/39165 — Flat glass; (2) opportunity costs because the low rate of interest on the amount of the fine belatedly returned to the applicant following the Court of Justice’s judgment in 2014 was much lower than the potential return that the applicant could have achieved if, instead of paying this money to the Commission in 2008, it had invested it in its business; and (3) non-pecuniary damages due to the decision wrongly having imposed the highest fine on the applicant in November 2007 and, due to the General Court’s failure to adjudicate within a reasonable time, this only being belatedly remedied by the Court of Justice in November 2014.

14. ‘leniency corporate statement’ means an oral or written presentation voluntarily provided by, or on behalf of, an undertaking to a competition authority, describing the undertaking’s knowledge of a secret cartel and its role therein, which was drawn up specifically for submission to the authority with a view to obtaining immunity or a reduction of fines under a leniency programme concerning the application of Article 101 of the Treaty or the corresponding provision under national law; this does not include documents or information that exist irrespective of the proceedings of a competition authority (‘pre-existing information’);

(18) En plus de garantir que l'entreprise d'assurance a un représentant dans l'État de résidence de la personne lésée, il convient de garantir le droit spécifique de la personne lésée d'obtenir le règlement du litige dans les meilleurs délais. En conséquence, les législations nationales doivent prévoir des sanctions financières efficaces et systématiques appropriées ou des sanctions administratives équivalentes, telles que des injonctions combinées à des amendes administratives, l'obligation de présenter régulièrement un rapport aux autorités de surveillance, des contrôles sur place, des publications au Journal officiel national ainsi que dans la presse, la suspension des activités de la société (interdiction de conclure de nouveaux contrats pendant une certaine période), la désignation d'un représentant spécial des autorités de surveillance chargé de vérifier que la conduite des affaires est conforme à la législation en matière d'assurances, le retrait de l'autorisation pour cette branche d'activité, des sanctions à appliquer aux dirigeants responsables et au personnel d'encadrement, les différentes sanctions énumérées ci-dessus pouvant être appliquées à l'encontre de l'entreprise d'assurance dans le cas où celle-ci ou son représentant manquerait à son obligation de présenter une offre d'indemnisation dans un délai raisonnable. (18) In addition to ensuring that the insurance undertaking has a representative in the State where the injured party resides, it is appropriate to guarantee the specific right of the injured party to have the claim settled promptly; it is therefore necessary to include in national law appropriate effective and systematic financial or equivalent administrative penalties - such as injunctions combined with administrative fines, reporting to supervisory authorities on a regular basis, on-the-spot checks, publications in the national official journal and in the press, suspension of the activities of the company (prohibition on the conclusion of new contracts for a certain period), designation of a special representative of the supervisory authorities responsible for monitoring that the business is run in line with insurance laws, withdrawal of the authorisation for this business line, sanctions to be imposed on directors and management staff - in the event that the insurance undertaking or its representative fails to fulfil its obligation to make an offer of compensation within a reasonable time-limit; this should not prejudice the application of any other measure - especially under supervisory law - which may be considered appropriate; however, it is a condition that liability and the damage and injury sustained should not be in dispute, so that the insurance undertaking is able to make a reasoned offer within the prescribed time-limit; the reasoned offer of compensation should be in writing and contain the grounds on the basis of which liability and damages have been assessed.
