Ces avis contiennent les informations visées à l’annexe VI, partie A, section I. Ils sont publiés soit par l’Office des publications de l’Union européenne, soit par les entités adjudicatrices sur leur profil d’acheteur conformément à l’annexe IX, point 2 b). Lorsque ce sont les entités adjudicatrices qui publient l’avis périodique indicatif sur leur profil d’acheteur, celles-ci envoient à l’Office des publications de l’Union européenne un avis de publication de l’avis périodique indicatif sur leur profil d’acheteur conformément à l’annexe IX, point 3. Ces avis contiennent les informations mentionnées à l’annexe VI, partie B.
Those notices shall contain the information set out in part A, section I of Annex VI. They shall be published either by the Publications Office of the European Union or by the contracting entities on their buyer profiles in accordance with point 2(b) of Annex IX. Where the periodic indicative notice is published by the contracting entities on their buyer profile, they shall send a notice of the publication of the periodic indicative notice on a buyer profile to the Publications Office of the European Union in accordance with point 3 of Annex IX. Those notices shall contain the information set out in Annex VI Part B.

4. The Publications Office of the European Union shall ensure that the full text and the summary of periodic indicative notices referred to in Article 67(2), calls for competition setting up a dynamic purchasing system as referred to in point (a) of Article 52(4) and notices on the existence of a qualification system used as a means of calling for competition in accordance with point (b) of Article 44(4) continue to be published:

It serves to apprise them of the value judgement made in regard to their performance and enables them to satisfy themselves, where appropriate, that they have not in fact obtained the number of points required by the notice of competition in order to be admitted to certain tests or to all the tests and enables the Tribunal to carry out a judicial review appropriate for that type of dispute (Konstantopoulou v Court of Justice, paragraph 33).

Since a company cannot be certain that it will be selected in the sample, exporters/producers that wish to claim an individual margin pursuant to Article 17(3) of the basic Regulation are advised to request a questionnaire and the market economy treatment and/or individual treatment (MET/IT) claim form within the deadline foreseen in point 6(a)(i) of this notice, and file these within the deadlines specified in point 6(a)(ii) first paragraph and 6(d) respectively of this notice.

where the opinion on the compliance of systems under Article 71(2) is without reservations, or where reservations have been withdrawn following corrective measures, the Commission may conclude that it can rely principally on the opinion referred to in Article 62(1)(d)(ii) with regard to the effective functioning of the systems and that it will carry out its own on-the-spot audits only if there is evidence to suggest shortcomings in the system affecting expenditure certified to the Commission in a year for which an opinion under Article 62(1)(d)(ii) has been provided which contains no reservation in respect of such shortcomings.

(a) the time limit for the receipt of requests to participate, in response to a notice published under Article 42(1)(c), or in response to an invitation by the contracting entities under Article 47(5), shall, as a general rule, be fixed at no less than 37 days from the date on which the notice or invitation was sent and may in no case be less than 22 days if the notice is sent for publication by means other than electronic means or fax, and at no less than 15 days if the notice is transmitted by such means.

These reduced time limits are permitted, provided that the periodic indicative notice has included, in addition to the information required by Annex XV A, part I, all the information required by Annex XV A, part II, insofar as the latter information is available at the time the notice is published, and that the notice has been sent for publication between 52 days and 12 months before the date on which the contract notice referred to in Article 42(1)(c) is sent.
