1a. Community institutions and bodies shall endeavour to assist the public by providing the best possible guidance to enable it to seek access to information, facilitate its participation in decision-making, and enable it to seek access to justice in environmental matters.

Community institutions and bodies shall make all reasonable efforts to maintain environmental information held by or for them in forms or formats that are readily reproducible and accessible by computer telecommunications or by other electronic means.

2. 2. In applying the provisions of this Regulation, the Community institutions and bodies shall endeavour to assist and provide guidance to the public with regard to access to information, participation in decision-making and access to justice in environmental matters.

Lorsqu’une institution ou un organe communautaire reçoit une demande d’accès à des informations environnementales qui ne sont pas en sa possession, l’institution ou l’organe en question indique le plus rapidement possible, et dans un délai de quinze jours ouvrables au plus tard, au demandeur l’institution communautaire, l’organe communautaire ou l’autorité publique au sens de la directive 2003/4/CE auprès duquel/de laquelle il est possible, à sa connaissance, de demander l’information souhaitée, ou transfère la demande à l’institution communautaire, l’organe communautaire ou l’autorité publique compétent(e) et en informe le demandeur.
Where a Community institution or body receives a request for access to environmental information and where this information is not held by that Community institution or body, it shall, as promptly as possible, but within 15 working days at the latest, inform the applicant of the Community institution or body or the public authority within the meaning of Directive 2003/4/EC to which it believes it is possible to apply for the information requested or transfer the request to the relevant Community institution or body or the public authority and inform the applicant accordingly.

Given that acts adopted by a Community institution or body acting in a judicial or legislative capacity can be excluded, the same should apply to other inquiry procedures where the Community institution or body acts as an administrative review body under provisions of the Treaty.

It was also agreed that when taking a decision on an environmental plan or programme the relevant Community institution and body shall inform (and not just "make reasonable efforts to inform") the public about this decision.
