C. considérant que, le 6 novembre 2014, la Chambre de première instance a ordonné d'office la mise en liberté provisoire de Vojislav Šešelj, après plus de onze ans d'emprisonnement et alors que son procès est toujours en cours, pour des raisons humanitaires liées à la dégradation de son état de santé, sous réserve i) qu'il s'abstienne d'influencer les témoins ou les victimes et ii) qu'il comparaisse devant la Chambre aussitôt qu'elle l'ordonne; considérant que Vojislav Šešelj a adopté, dès le début du procès, une attitude hostile envers le TPIY, interrompant, ralentissant et retardant de manière répétée les procédures devant la Cour, et qu'il a été condamné pour outrage au Tribunal à trois reprises pour intimidation de témoins;
C. whereas on 6 November 2014, after more than eleven years of detention and while his trial is still ongoing, the Trial Chamber of the Tribunal issued an order proprio motu for the provisional release of Šešelj on the grounds of the deterioration of his health, subject to the conditions that he: (i) does not influence witnesses and victims; and (ii) appears before the Chamber as soon as it so orders; whereas Šešelj has displayed a hostile attitude towards the ICTY since the start of the trial by repeatedly interrupting, disrupting and retracting the proceedings before the Court, and has been charged with contempt of court on three separate occasions for intimidation of witnesses;

For instance, a remedy should be available to the debtor if the case did not constitute a cross-border case as defined in this Regulation, if the jurisdiction rules set out in this Regulation were not respected, if the creditor did not initiate proceedings on the substance of the matter within the period of time provided for in this Regulation and the court did not, as a consequence, revoke the Order of its own motion or the Order did not terminate automatically, if the creditor’s claim was not in need of urgent protection in the form of a Preservation Order because there was no risk that the subsequent enforcement of that claim would be impeded or made substantially more difficult, or if the provision of security was not in conformity with the requirements set out in this Regulation.

Should the creditor fail to comply with this obligation, the Order should be revoked by the court of its own motion or should terminate automatically.

' Motion No. 52 That Bill C-14 be amended by adding after line 39, on page 68, the following new Clause: ``146.14(1) The Agency may rescind an order that the operation of a branch line or segment thereof be abandoned, only (a) before the date for abandonment fixed therein; and (b) with the concurrence of the railway company that operates the line or segment; and (2) The Agency may vary the date fixed in an order for the abandonment of the operation of a main line or segment thereof before that date only by fixing a later date that is within two years after the date of the order for the abandonment and is not later than one year after the later of the date of the order for the abandonment and the last variation order, if any'.
