A. considérant qu'Ali Mohammed al-Nimr, âgé de 21 ans et neveu d'un célèbre opposant au régime, a été condamné à mort, semble-t-il par décapitation suivie d'une crucifixion, par la Cour suprême d'Arabie saoudite en mai 2015 pour des chefs d'accusation qui incluent la participation à des actes séditieux, à des émeutes, à des manifestations et à des vols, ainsi que l'appartenance à un groupement terroriste, et que l'intéressé était âgé de moins de 18 ans, et était donc mineur, au moment de son arrestation lors d'une manifestation en faveur de la démocratie et de l'égalité des droits en Arabie saoudite; qu'Ali Mohammed al‑Nimr a été condamné à mort en raison des manifestations dans la province à majorité chiite de l'est de l'Arabie saoudite; que des sources fiables attestent qu'il a été torturé et qu'il a signé ses aveux sous la contrainte; qu'il n'a reçu aucune garantie quant à la tenue d'un procès équitable et au déroulement de procédures judiciaires régulières en conformité avec le droit international;
A. whereas Ali Mohammed al-Nimr, who is 21 years old and is a nephew of a prominent dissident, was sentenced in May 2015 to capital punishment, reportedly by beheading followed by crucifixion, by Saudi Arabia’s Supreme Court on criminal charges including sedition, rioting, protesting robbery and belonging to a terror cell whereas Ali al-Nimr was under the age of 18 – and thus still a juvenile – at the time he was arrested while demonstrating for democracy and equal rights in Saudi Arabia; whereas he was sentenced to death on account of the protests in the mostly Shia Eastern Province of Saudi Arabia; whereas it is alleged by reliable sources that Ali al-Nimr was tortured and forced to sign his confession; whereas he has been denied any guarantees of a safe trial and due legal process in compliance with international law;

6. constate que, selon le rapport de la Cour, les rapports d'audit transmis par les autorités de financement nationales à l'entreprise commune portent sur environ 46 % des coûts relatifs aux projets achevés; constate avec inquiétude que l'entreprise commune n'a pas évalué la qualité de ces audits et que, à la fin mars 2014, sept des 23 autorités de financement nationales ne lui avaient pas fourni les informations relatives aux stratégies d'audit; observe en outre que l'entreprise commune n'était donc pas en mesure de juger si les audits ex post permettaient d'obtenir une assurance suffisante quant à la légalité et à la régularité des opérations sous-jacentes;
6. Notes that according to the Court's report, the Joint Undertaking received audit reports from the NFAs covering approximately 46 % of the costs relating to completed projects; notes with concern that the Joint Undertaking did not assess the quality of those audits and that, by the end of March 2014, the Joint Undertaking had not received information on the audit strategies of seven out of 23 NFAs; notes moreover that the Joint Undertaking was therefore not in a position to assess whether ex post audits provide sufficient assurance as to the legality and regularity of the underlying transactions;

5. rappelle que, selon le rapport d'audit de la Cour des comptes, les paiements effectués en 2012 et relatifs aux certificats de prise en charge émis par les autorités de financement nationales des États membres se sont élevées à 7,3 millions d'euros, soit 43 % du total des paiements opérationnels ; est préoccupé par le fait que, selon ce même rapport d'audit de la Cour des comptes, les rapports d'audit transmis par les autorités de financement nationales à l'entreprise commune Artemis couvrent environ 45 % des coûts relatifs aux projets achevés, que l'entreprise n'a pas évalué la qualité de ces audits, que, à fin avril 2013, les autorités de financement nationales n'avaient pas toutes fourni à l'entreprise commune les informations concernant les stratégies d'audit et qu'Artemis n'était donc pas en mesure de juger si les audits ex-post permettent d'obtenir une assurance suffisante quant à la légalité et à la régularité des opérations sous-jacentes;

Points out that, according to the audit report by the Court of Auditors, payments made in 2012 relating to certificates of acceptance of costs issued by the Member States' NFAs amounted to EUR 7,3 million, which represents 43% of total operational payments; is concerned that, according to that Court of Auditors' report, the Joint Undertaking received audit reports from the NFAs covering approximately 45% of the costs relating to completed projects, that the Joint Undertaking did not assess the quality of those audits, that, by the end of April 2013, the Joint Undertaking had not received information on the audit strategies of all NFAs, and that the Joint Undertaking was therefore not in a position to assess whether ex post audits provide sufficient assurance as to the legality and regularity of the underlying transactions;

La CES a indiqué que le délai fixé pour la transposition de la directive n’était arrivé à échéance que depuis relativement peu de temps, que de nombreux États membres avaient procédé à une transposition tardive et qu’il était donc trop tôt pour évaluer convenablement la situation au niveau national.
ETUC stressed that the deadline for the transposition of the Directive was relatively recent and that many Member States had carried out the transposition belatedly. For those reasons, it was too early for a decent evaluation of the situation at national level.

Considérant que cette idée ne pouvait être ignorée de Freixenet, le Tribunal a jugé que cette dernière était donc parfaitement en mesure de réfuter l’idée retenue par l’examinateur, puis par la première chambre de recours de l’OHMI, pour établir l’absence de caractère distinctif des marques dont l’enregistrement était demandé et pouvait ainsi faire valoir que c’était non pas l’étiquette mais le conditionnement du vin mousseux qui était habituellement pris en considération par le consommateur concerné dans le choix de ce produit.
Considering that Freixenet could not have been unaware of that idea, the Court held that Freixenet was therefore perfectly able to refute the argument put forward by the examiner and then accepted by the First Board of Appeal to establish the absence of any distinctive character of the marks for which registration was sought; it could thus have argued that it was not the label but the packaging of the sparkling wine which was normally taken into consideration by the consumer concerned in choosing that product.

Le Tribunal a, en outre, précisé, aux points 122 et 118 respectivement des arrêts T‑109/08 et T‑110/08, que les marques dont l’enregistrement était demandé étant constituées par la présentation d’un produit, il n’existait pas d’obstacle linguistique à leur enregistrement et que c’était donc, en principe, dans toute la partie de la Communauté où le caractère distinctif intrinsèque faisait défaut qu’il convenait d’établir l’acquisition du caractère distinctif par l’usage pour que ces marques puissent être enregistrables en vertu de l’article 7, paragraphe 3, du règlement nº 40/94.
The Court stated further, at paragraphs 122 and 118 of the judgments in T-109/08 and T-110/08 respectively, that since the marks for which registration was sought consisted of the presentation of a product, there was no language barrier to their registration and it was, therefore, in principle, in all parts of the Community where the inherent distinctive character was missing that the acquisition of distinctive character through use had to be established in order for those marks to be registered in accordance with Article 7(3) of Regulation No 40/94.
