20. affirme que, pour mettre en oeuvre l'interdiction, spécifiquement formulée par la Conférence internationale sur la population et le développement (CIPD) du Caire, de la coercition ou de la contrainte en matière de santé sexuelle et génésique, au regard des instruments internationaux contraignants relatifs aux droits de l'homme, de l'acquis communautaire de l'Union et de ses compétences dans ce domaine, l'Union ne doit apporter son assistance à aucune autorité, aucune organisation ou aucun programme qui favorise, soutient ou participe à la gestion de toute action qui implique des violations des droits humains telles que l'avortement forcé, la stérilisation forcée des femmes ou des hommes, la détermination du sexe du foetus entraînant la sélection prénatale ou l'infanticide, en particulier lorsque ces actions s'exercent au moyen de pressions psychologiques, sociales, économiques ou juridiques; estime que la Commission doit présenter un rapport sur la mise en oeuvre de l'assistance extérieure de l'Union couvrant ce programme;
20. Asserts that, in implementing the specific Cairo International Conference on Population and Development (ICPD) prohibition on coercion or compulsion in sexual and reproductive health matters, with regard to the legally binding international human rights instruments, the EU acquis communautaire and the Union policy competencies in this matter, Union assistance should not be provided to any authority, organisation or programme which promotes, supports or participates in the management of any action which involves such human rights abuses as coercive abortion, forced sterilisation of women and men, determining foetal sex resulting in prenatal sex selection or infanticide, especially where such actions set their priorities in response to psychological, social, economic or legal pressure. The Commission should present a report on the implementation of the Union’s external assistance covering this programme;

B. considérant que la Hongrie a signé la Convention européenne des droits de l'homme, le Pacte international relatif aux droits civils et politiques et d'autres instruments juridiques internationaux qui l'obligent à respecter et à mettre en oeuvre les principes de séparation des pouvoirs, d'équilibrage des pouvoirs institutionnels et de promotion de la démocratie et des droits de l'homme,
B. whereas Hungary has signed the ECHR, the ICCPR and other international legal instruments obliging it to respect and implement principles concerning the separation of powers, the implementation of institutional checks and balances and the promotion of democracy and human rights,

* work together to strengthen our cooperation in the United Nations, for example in working for the early and comprehensive ratification of major international instruments such as the CTBT or the conventions on small arms and anti-personnel mines, and for a future global anti-corruption instrument; enhancing the non-proliferation regime and efforts to control other weapons of mass destruction; working for the reform of the UN system including a comprehensive reform of the Security Council in all its aspects; working to strengthen UN peacekeeping efforts through the support of a timely implementation of the recommendations contained in the Brahimi Report; and reinforcing the functioning of the UN system by encouraging a prompt and full payment by all partners of contributions based on the new scales of assessment including arrears;

17. estime que la Communauté devrait jouer un rôle actif afin que soient décidés puis mis en oeuvre les instruments juridiques internationaux indispensables à la gestion et au contrôle de l'exploitation des ressources partagées; considère également que, dans le cadre de sa politique de développement, la Communauté européenne devrait aider financièrement les pays en développement partenaires à appliquer ces engagements internationaux auxquels ils ont souscrit;
17. Considers that the Community should play an active role in ensuring that the international legal instruments essential for the management and control of the exploitation of shared resources are adopted and then applied; considers also that, in the context of its development policy, the Community should offer the partner developing countries financial assistance to enable them to implement these international commitments to which they have subscribed;

Les causes sont à rechercher dans des facteurs d'ordre constitutionnel et structurel du système de fonctionnement de la coopération judiciaire: disparité, entre les quinze États membres, des codes pénals et de procédure pénale; lenteur dans la mise en oeuvre des réformes internes et essentiellement des instruments internationaux; disproportion entre les coûts de la coopération judiciaire en termes de temps, de bureaucratie et d'argent et le bénéfice qui en est retiré en termes d'acquisition de preuves, d'information, etc.
The causes are to be found in constitutional and structural aspects of the judicial cooperation system, such as the differences between the respective codes of criminal procedure of the 15 Member States, the delays in implementing internal reforms, particularly as regards international instruments, and the disparity between the costs of judicial cooperation in terms of time, paperwork and money and the actual results obtained in terms of acquiring evidence, information, etc.

Sans préjudice des compétences de la Communauté, un mécanisme d'évaluation par les pairs de l'application et de la mise en oeuvre au plan national des actes et instruments de l'Union européenne et des autres actes et instruments internationaux en matière pénale, de la législation et des pratiques qui en résultent sur le plan national, ainsi que des actions de coopération internationale suivies en matière de lutte contre la criminalité organisée dans les États membres est institué selon les modalités définies ci-après.

Without prejudice to the competence of the Community, a mechanism for peer evaluation of the application and implementation at national level of Union and other international acts and instruments in criminal matters, of the resulting legislation and practices at national level and of international cooperation actions in the fight against organized crime in the Member States shall be established in accordance with the detailed rules set out below.
