A. considérant que, sur la base des informations divulguées par Edward Snowden, ancien agent de renseignements de la NSA qui cherche actuellement à obtenir un asile politique, les journaux du monde entier ont révélé l'existence d'un programme des États-Unis, appelé Prism, qui impliquerait la surveillance à grande échelle des communications de citoyens non américains, et donc également de citoyens européens;
A. whereas newspapers across the world have revealed the existence of a US programme called PRISM, following information leaked by Edward Snowden, a former NSA intelligence officer who is now applying for political asylum , which allegedly entails the surveillance of communications of non-US citizens, hence including also European citizens, on a vast scale;

5.3. avoid any new kind of "black list" or new, specialised database between Member States, other than the SIS and SIRENE databases, and ensure an effective right to rectify information by the individuals concerned (recognised by Article 8 of the ECFR) and the right to obtain judicial scrutiny in case of abuse, notably if it concerns personal data revealing political opinions (contrary to Articles 11 and 12 of the ECFR);

V. considérant que l'Autorité de contrôle commune, dans son troisième rapport annuel (mars 1998-février 1999) et dans son quatrième rapport annuel (mars 1999-février 2000), a constaté des lacunes concernant le fonctionnement du SIS dans le traitement des données à caractère personnel, notamment que les autorités nationales ne révèlent pas systématiquement les motifs des enquêtes effectuées dans le cadre du SIS, conservent des documents relatifs à des signalements après que ceux-ci aient été supprimés, et les utilisent pour compléter les fichiers criminels; considérant qu'est maintenu dans le SIS un signalement sur les personnes dont l'identité est usurpée sans en informer lesdites personnes ni obtenir leur autorisation, qu'il y a une utilisation abusive des données et que les procédures de vérification et de correction des données sont trop lentes ou inappropriées,
V. whereas the Joint Supervisory Authority in its Third Annual report (March 1998 to February 1999) and in its Fourth Annual Report (March 1999 to February 2000) identified shortcomings in the treatment of personal data in the operation of the SIS, including: failures of the approved authorities to give reasons for their enquiries in the SIS; failure to destroy documents relating to alerts after the alerts had been deleted and use of these documents to supplement police records; maintenance on the SIS of data on persons whose identity has been usurped with no attempt to inform or obtain the consent of the legitimate holder of the identity that his/her data is contained on the SIS system; the abusive use of data; and slow or inadequate procedures for checking and correcting data,
