Calls on the Commission to conduct, before the end of 2014, an in-depth assessment of the existing Mutual Legal Assistance Agreement, pursuant to its Article 17, in order to verify its practical implementation and, in particular, whether the US has made effective use of it for obtaining information or evidence in the EU and whether the Agreement has been circumvented to acquire the information directly in the EU, and to assess the impact on the fundamental rights of individuals; such an assessment should not only refer to US official statements as a sufficient basis for the analysis but also be based on specific EU evaluations; this in-depth review should also address the consequences of the application of the Union’s constitutional architecture to this instrument in order to bring it into line with Union law, taking account in particular of Protocol 36 and Article 10 thereof and Declaration 50 concerning this protocol; calls on the Council and Commission also to assess bilateral agreements between Member States and the US so as to ensure that they are consistent with the agreements that the EU follows or decides to follow with the US;

3. Whenever it appears to the Commission, either on the basis of the reports referred to in paragraph 2 or on the basis of other information, that a third country does not grant undertakings having their seat or their principal fields of activity in the Community, treatment comparable to that granted by the Community to undertakings from that country, the Commission may submit proposals to the Council for an appropriate mandate for negotiation with a view to obtaining comparable treatment for undertakings having their seat or their principal fields of activity in the Community.

Néanmoins, je voudrais garantir aux honorables députés que la Commission est disposée à se montrer ouverte en ce qui concerne certains amendements, tels que la couverture géographique du système, les modalités de son application aux pays candidats ou autres et, en tout cas, nous ferons preuve de la flexibilité nécessaire pour obtenir dans le cadre de la conciliation un accord que nous souhaitons tous. Nous travaillerons pour obtenir cet accord, même si cela nous paraît très difficile en raison des désaccords substantiels entre le Parlement et le Conseil.
I would like to assure the honourable Members, however, that the Commission is prepared to adopt an open attitude towards amendments such as the geographical scope of the system, the methods for applying it to candidate countries and others and, in any event, we will show the flexibility necessary to achieve the agreement we all want to see within the context of the conciliation and we will work to try to achieve it, although this would appear to be very difficult, since the differences between Parliament and the Council are very significant.

3. Whenever it appears to the Commission, either on the basis of the reports referred to in paragraph 2 or on the basis of other information, that a third country is not granting Community assurance undertakings effective market access comparable to that granted by the Community to insurance undertakings from that third country, the Commission may submit proposals to the Council for the appropriate mandate for negotiation with a view to obtaining comparable competitive opportunities for Community assurance undertakings.

4. Lorsque la Commission constate, soit sur la base des rapports visés au paragraphe 3, soit sur la base d'autres informations, qu'un pays tiers n'accorde pas aux établissements de crédit de la Communauté un accès effectif au marché comparable à celui qu'offre la Communauté aux établissements de crédit de ce pays tiers, elle peut soumettre des propositions au Conseil en vue d'obtenir un mandat de négociation approprié pour obtenir des possibilités de concurrence comparables pour les établissements de crédit de la Communauté.

Whenever it appears to the Commission, either on the basis of the reports referred to in paragraph 3 or on the basis of other information, that a third country is not granting Community credit institutions effective market access comparable to that granted by the Community to credit institutions from that third country, the Commission may submit proposals to the Council for the appropriate mandate for negotiation with a view to obtaining comparable competitive opportunities for Community credit institutions.
