À l'initiative de la Commission, le Fonds peut financer, dans la limite de 2% de ses ressources disponibles, des actions transnationales ou d'intérêt communautaire (ci-après, les «actions communautaires») en rapport avec l'objectif général visant à contribuer à l'amélioration des activités organisées par les services consulaires des États membres dans les pays tiers et la coopération entre États membres dans ce domaine, et avec l'objectif visant à encourager l'inclusion progressive des contrôles douaniers, vétérinaires et phytosanitaires dans la gestion intégrée des frontières, selon l'évolution que connaîtront éventuellement les politiques en cette matière.
1. At the Commission’s initiative, up to 2% of the Fund’s available resources may be used to finance transnational actions or actions of interest to the Community as a whole (‘Community actions’) concerning the general objective of contributing to enhancement of the activities organised by the consular services of the Member States in third countries and the co-operation between Member States thereof and the objective of promoting the progressive inclusion of the customs, veterinary, phyto-sanitary controls in integrated border management activities according to the policy evolution in this field.

Le nouveau règlement relatif au FSE prévoit spécifiquement une concentration des ressources sur les objectifs communautaires dans le domaine de la stratégie européenne pour l’emploi, y compris les objectifs liés à l’emploi qui relèvent de l’inclusion sociale, de l’éducation et de la formation.
The new ESF regulation specifically calls for a concentration of resources on Community objectives in the area of the European Employment Strategy, including the relevant employment-related objectives in the field of social inclusion, education, and training.

4. Les indicateurs inclus dans les programmes opérationnels bénéficiant d'un cofinancement du FSE ont un caractère stratégique, sont limités en nombre et reflètent ceux utilisés dans la mise en œuvre de la stratégie européenne pour l'emploi et dans le cadre des objectifs communautaires pertinents dans les domaines de l'inclusion sociale et de l'éducation et de la formation.
4. The indicators included in the operational programmes co-financed by the ESF shall be strategic in nature and limited in number and shall reflect those used in the implementation of the European Employment Strategy and in the context of the relevant Community objectives in the fields of social inclusion and education and training.

La Commission encourage en particulier les échanges d'expérience, les activités de sensibilisation, les séminaires, la mise en réseau et les évaluations par les pairs servant à recenser et à diffuser les bonnes pratiques et à favoriser l'apprentissage mutuel ainsi que la coopération transnationale et interrégionale en vue de renforcer la dimension politique et la contribution du FSE aux objectifs communautaires en matière d'emploi et d'inclusion sociale.
The Commission shall promote, in particular, exchanges of experience, awareness-raising activities, seminars, networking and peer reviews serving to identify and disseminate good practice and encourage mutual learning and transnational and interregional cooperation with the aim of enhancing the policy dimension and contribution of the ESF to the Community objectives in relation to employment and social inclusion.

5. Les évaluations réalisées en rapport avec l'action du FSE portent également sur la contribution des actions soutenues par le FSE à la mise en œuvre, dans l'État membre concerné, de la stratégie européenne pour l'emploi et à la réalisation des objectifs communautaires dans les domaines de l'inclusion sociale, de la non-discrimination, de l'égalité entre les hommes et les femmes et de l'éducation et de la formation.
5. Evaluations undertaken in relation to ESF action shall also assess the contribution of the actions supported by the ESF to the implementation of the European Employment Strategy and to the Community objectives in the fields of social inclusion, non-discrimination and equality between women and men, and education and training in the Member State concerned.

Dans son avis, la Commission conclut que la mise en oeuvre du projet de législation compromettrait sérieusement la réalisation des objectifs communautaires dans le domaine de la politique commune des transports routiers, dans la mesure où - des actions unilatérales seront provoquées de la part des autres Etats membres, qui verront discriminés leur propres véhicules, - des délais supplémentaires pour l'adoption des propositions de la Commission en résulteront, - de nouveaux contrôles aux frontières seront instaurés dans le cas où le droit pour l'usage des routes devrait être payé aux frontières, - 2 - - les négociations relatives aux problèmes de transit, y inclus les taxes sur les véhicules et les taxes routières avec l'Autriche, la Suisse et la Yougoslavie seront mises en péril.
The conclusion of the Commission's opinion was that the proposed legislation would seriously jeopardize the aims of the Community road transport policy in that: - other Member States, seeing their vehicles discriminated against, would be provoked into unilaterally adapting counter-measures; - it would further delay the adoption of Commission proposals; - it would mean new border controls if the road charge was payable at the frontier; -2- - the negotiations on transit problems, including vehicle taxes and road charges, with Austria, Switzerland and Yugoslavia would be endangered.

Quant à la substance de la réforme, il est rappelé que le Conseil européen d'Edimbourg n'avait pas seulement décidé des ressources disponibles pour les fonds structurels (voir annexe) et les autres opérations structurelles de la Communauté pour la période 1993-1999, mais avait défini également un certain nombre d'éléments fondamentaux pour la poursuite de l'action communautaire dans le domaine structurel pendant cette période, à savoir notamment : - une fourchette de 5 à 10 % des ressources totales pour les montants à affecter aux initiatives communautaires ; - la prise en compte de la prospérité nationale, de la prospérité régionale, de la population des régions et de la gravité relative des problèmes structurels, y compris le niveau de chômage et, pour les objectifs appropriés, des besoins de développement dans les zones rurales, en tant que critères de l'action structurelle ; - que les principes de bases fixés en 1988 - concentration, programmation, partenariat et additionalité devaient continuer à guider la mise en oeuvre des fonds structurels ; - la couverture de l'objectif n° 1 à déterminer selon des critères similaires à ceux du règlement de 1988 et notamment l'inclusion des nouveaux Länder allemands et de Berlin-Est.
As to the substance of the reform, it was noted that the Edinburgh European Council not only decided on the resources available for the Structural Funds (see Annex) and the other Community structural operations for the period 1993 to 1999, but also laid down a number of basic principles for continuing the Community's structural action during this period, and particularly: - the allocation for Community initiatives should be between 5% and 10% of total resources; - account should be taken of national prosperity, regional prosperity, population of the regions, and the relative severity of structural problems, including the level of employment, and, for the appropriate objectives, the needs of rural development, in the form of criteria for structural action; - the basic principles laid down in 1988 (concentration, programming, partnership and additionality) should continue to guide the implementation of the Structural Funds: - the coverage of Objective 1 should be determined according to criteria similar to those of the 1988 Regulation and should include the new German Länder and East Berlin.
