D'autres modifications dudit règlement ont été introduites par le règlement (CE) no 648/2005 du Parlement européen et du Conseil du 13 avril 2005 (6) - - et incluses par la suite dans le règlement (CE) no 450/2008 - en raison des importantes mutations juridiques qui se sont produites ces dernières années, tant au niveau de l'Union qu'au niveau international, comme l'expiration du traité instituant la Communauté européenne du charbon et de l'acier, l'entrée en vigueur des actes d'adhésion de 2003, 2005 et 2011 et l'amendement à la convention internationale pour la simplification et l'harmonisation des régimes douaniers (ci-après dénommée "convention de Kyoto révisée"), auquel l'adhésion de l'Union a été approuvée par la décision 2003/231/CE du Conseil du 17 mars 2003 (7).
Further amendments to that Regulation were introduced by Regulation (EC) No 648/2005 of the European Parliament and of the Council of 13 April 2005 (6) - and subsequently included in Regulation (EC) No 450/2008 - as a consequence of the important legal changes which have occurred in recent years, at both Union and international level, such as the expiry of the Treaty establishing the European Coal and Steel Community and the entry into force of the 2003, 2005 and 2011 Acts of Accession, as well as the amendment to the International Convention on the simplification and harmonisation of customs procedures (the Revised Kyoto Convention), the Union's accession to which was approved by Council Decision 2003/231/EC of 17 March 2003 (7).

In this regard, it has to be recalled, first, that the harmonisation system to which these provisions belong does not foresee maximum rates, which implies that Member States may fix their national rates at any point equal or above the minimum rate, including for reasons of health protection.

Accordingly, the Court frequently reiterates that, it is for the Member States, in the absence of harmonisation and to the extent that uncertainties continue to exist in the current state of scientific research, to decide on their intended level of protection of human health and life and on whether to require prior authorisation for the marketing of foodstuffs, always taking into account the requirements of the free movement of goods within the Community.

Suite à l'accord politique auquel le Conseil est parvenu en mai 2001 sur la proposition de décision-cadre relative à l'introduction clandestine des migrants, il reste aussi à oeuvrer à l'harmonisation du droit pénal des États membres et à veiller à une mise en oeuvre aussi rapide que possible au niveau national.
Following the political agreement reached at the Council in May 2001 on the proposal for a Framework Decision on smuggling of migrants, work needs also to be completed with a view to harmonise the Member States penal legislation and to ensure as soon as possible the implementation at national level.
