La coopération judiciaire civile obéit donc à deux régimes distincts depuis l'entrée en vigueur du traité de Nice : la co-décision en tant que procédure de droit commun, et le régime dérogatoire réservé aux mesures touchant des aspects du droit de la famille, où le Conseil adopte les décisions à l'unanimité après avis consultatif du Parlement européen.
Judicial cooperation in civil matters has thus been governed by two separate procedures since the Treaty of Nice entered into force - the codecision procedure, which is now the standard procedure, and adoption by the Council, acting unanimously after consulting the European Parliament, which is the exceptional procedure for measures involving aspects relating to family law.

Considers that the European Council in Nice demonstrates that the traditional IGC method is unsuitable; considers therefore that work on the 'post-Nice' agenda is vital; to this end a Convention similar to the one which produced the Charter of Fundamental Rights should be convened, comprising representatives from the applicant countries as well as those of the Union in which no party has a right of veto; after a broad public debate it should produce a draft to reform, simplify and reorganise the Treaties into a single, clear and concise document ('Constitution');

À notre avis, le résultat final de Nice dépendra très largement des discussions qui porteront en fin de compte sur le vote à la majorité qualifiée et je suis déterminé à faire tout le nécessaire pour parvenir à un accord qui apporte une valeur ajoutée.
For us, the final outcome of Nice depends very much on the discussions that will ultimately take place on qualified majority voting, and I am committed to doing whatever it takes to reach a deal that provides added value.
