TRADUCTIONS EN CONTEXTE

Le traité CE doit être interprété en ce sens que, eu égard aux dispositions de la directive 2001/77/CE du Parlement européen et du Conseil, du 27 septembre 2001, relative à la promotion de l’électricité produite à partir de sources d’énergie renouvelables sur le marché intérieur de l’électricité, la Communauté européenne dispose d’une compétence externe exclusive s’opposant à une disposition nationale, telle que celle en cause au principal, qui prévoit l’octroi d’une dispense de l’obligation d’acquérir des certificats verts à raison de l’introduction, sur le marché national de la consommation, d’électricité importée d’un État tiers, moyennant la conclusion préalable, entre l’État membre et l’État tiers concernés, d’un accord en vertu duquel l’électricité ainsi importée est garantie comme étant produite à partir de sources d’énergie renouvelables, selon des modalités identiques à celles que prévoit l’article 5 de ladite directive.
On a proper construction of the EC Treaty, having regard to the provisions of Directive 2001/77/EC of the European Parliament and of the Council of 27 September 2001 on the promotion of electricity produced from renewable energy sources in the internal electricity market, the European Community enjoys exclusive external competence precluding a provision of national law, such as that at issue in the main proceedings, which provides for the grant of exemption from the obligation to purchase green certificates owing to the introduction, onto the national consumer market, of electricity imported from a third State, by means of the prior conclusion, between the Member State and third State concerned, of an agreement under which the electricity thus imported is guaranteed as having been produced from renewable energy sources, according to arrangements identical to those set out in Article 5 of that directive;
