La Cour a constaté qu’un candidat potentiel dont la langue maternelle n’était pas l’une des langues de la publication intégrale des avis de concours litigieux était désavantagé par rapport à un candidat dont la langue maternelle était l’une de ces trois langues. Ce désavantage était la conséquence d’une différence de traitement disproportionnée en raison de la langue, interdite par l’article 21 de la Charte.
The Court found that a potential candidate whose mother tongue was not one of the languages of full publication of the contested competition notices was at a disadvantage compared to a candidate whose mother tongue was one of those three languages. That disadvantage was the consequence of a disproportionate difference in treatment on the ground of language, prohibited by Article 21 of the Charter.

In the light of the evidence set out above, the Tribunal finds that the applicant has failed to prove to the requisite legal standard that the fact that the candidates who were examined last had more time to prepare for the case study and some candidates could have obtained information from other candidates about the content of the version of the subject on which they were going to be examined, was capable of giving the candidates who sat the case study last a genuine advantage over the other candidates.
