– vu la demande de levée de l'immunité de Robert Jarosław Iwaszkiewicz, transmise en date du 13 août 2015 par le procureur général de la République de Pologne dans le cadre d'une procédure intentée par l'Inspecteur général polonais du transport routier (réf. n° CAN-PST-SCW.7421.1209083.2014.9.A.0475), et communiquée en séance plénière le 29 octobre 2015,
– having regard to the request for waiver of the immunity of Robert Jarosław Iwaszkiewicz, forwarded on 13 August 2015 by the Prosecutor-General of the Republic of Poland in connection with proceedings to be brought by the Polish General Inspector of Road Transport (Ref. No CAN-PST-SCW.7421.1209083.2014.9.A.0475), and announced in plenary on 29 October 2015,

– vu que Robert Jarosław Iwaszkiewicz a renoncé à son droit d'être entendu conformément à l'article 9, paragraphe 5, de son règlement,
– having regard to the fact that Robert Jarosław Iwaszkiewicz waived his right to a hearing, in accordance with Rule 9(5) of its Rules of Procedure,

A. considérant que le procureur général de la République de Pologne a transmis une requête de l'Inspecteur général polonais du transport routier demandant la levée de l'immunité de Robert Jarosław Iwaszkiewicz, député au Parlement européen élu pour la Pologne, en ce qui concerne une infraction au titre de l'article 92a du code des infractions mineures du 20 mai 1971, en liaison avec l'article 20, paragraphe 1, de la loi du 20 juin 1997 sur la circulation routière;
A. whereas the Prosecutor-General of the Republic of Poland has forwarded a request from the Polish General Inspector of Road Transport for waiver of the immunity of a Member of the European Parliament elected with respect to Poland, Robert Jarosław Iwaszkiewicz, in connection with an offence under Article 92a of the Code of Petty Offences of 20 May 1971 in conjunction with Article 20(1) of the Road Traffic Act of 20 June 1997;

D. considérant qu'il incombe, dès lors, au Parlement européen de décider si l'immunité de Robert Jarosław Iwaszkiewicz doit ou non être levée;
D. whereas it is thus incumbent upon the European Parliament to decide whether the immunity of Robert Jarosław Iwaszkiewicz is or is not to be waived;

F. considérant que l'infraction présumée n'a pas de rapport direct ou évident avec l'exercice par Robert Jarosław Iwaszkiewicz de ses fonctions de député au Parlement européen;
F. whereas the alleged offence does not have a direct or obvious connection with Robert Jarosław Iwaszkiewicz’s performance of his duties as a Member of the European Parliament;

Naturellement, cela n'empêchera pas l'échange de quotas entre États membres, comme c'est déjà le cas.
