Un mécanisme d’échange d’informations concernant les accords intergouvernementaux conclus entre des États membres et des pays tiers dans le domaine de l’énergie a été institué par une décision adoptée le 25 octobre 2012 par le Parlement européen et le Conseil et entrée en vigueur le 17 novembre 2012 (ci-après la «décision»).
An information exchange mechanism with regard to intergovernmental agreements (IGAs) between Member States and third countries in the field of energy was established by a Decision adopted by the Parliament and Council on 25 October 2012, which entered into force on 17 November 2012 (the IGA Decision).

La décision est étroitement liée à ce règlement, mais le champ d’application du mécanisme d’échange d’informations qu’elle établit est plus large.
The IGA Decision is closely linked to the Security of Gas Supply Regulation, but the scope of the information exchange mechanism it establishes is wider.

1.La présente décision établit un mécanisme d'échange d'informations entre les États membres et la Commission en ce qui concerne les accords intergouvernementaux et les instruments non contraignants dans le domaine de l'énergie tels qu'ils sont définis à l'article 2, en vue de garantir le fonctionnement optimal du marché intérieur de l'énergie.
1.This Decision establishes a mechanism for the exchange of information between Member States and the Commission with regard to intergovernmental agreements and non-binding instruments in the field of energy as defined in Article 2, in order to optimise the functioning of the internal energy market.

La Commission peut adopter, au moyen d'actes d'exécution, et en tenant dûment compte de tout mécanisme d'échange d'information ou formulaire unique mis au point par les guichets uniques et les autorités chargées de la protection des données, en coopération avec l'ENISA, les procédures des mécanismes d'échange d'information et le format du formulaire unique.
The Commission may adopt, by means of implementing acts and taking the utmost account of any information exchange mechanisms and single template developed by the single points of contact and the data protection authorities, in cooperation with ENISA, procedures for the information exchange mechanisms and the format of the single template.

Notes the creation of an information exchange mechanism for intergovernmental agreements between the Member States and third countries on energy policy, given that this mechanism is oriented at enhancing policy transparency, coordination and efficiency in the EU as a whole; calls on the Member States to show further ambition in ensuring that agreements contrary to internal energy market legislation are not put in place; considers that the Commission should be able to examine draft agreements for their compatibility with such legislation, and to participate in negotiations where relevant; considers that the information-exchange mechanism is a step towards further coordinating energy purchasing outside of the EU, which is of crucial importance for realising the goals of the Energy Roadmap 2050;

The application of the mechanisms established by this Framework Decision only to the transmission of information extracted from criminal records concerning natural persons should be without prejudice to a possible future broadening of the scope of application of such mechanisms to the exchange of information concerning legal persons.
