J. whereas, notwithstanding this, with the Union's accession to the ECHR, the Union may over time have to find a common yardstick in cross-border cases relating to the freedoms to supply goods and services as a result of the ‘dialectical development’ looked forward to by Advocate General Mancini in the Bond van Adverteerders case, having regard also to the judgments in Elliniki Radiofonia Tileorasi and Society for the Protection of Unborn Children Ireland Ltd and Advocate General Jacobs' opinion in Christos Konstantinidis ; indeed, in the case Society for the Protection of Unborn Children Ireland Ltd , Advocate General Van Gerven put forward the proposition that ‘a national rule which in order to show that it is compatible with [Union] law has to rely on legal concepts, such as imperative requirements of public interest or public policy .falls ’within the scope' of [Union] law' on the ground that, although the Member States have some discretion in defining the public interest or public policy concepts, the scope of those concepts in the case of measures falling within the scope of Union law is nevertheless subject to Union control and they have to be ‘justified and delimited in a uniform manner for the whole [Union] under [Union] law and therefore taking into account the general principles in regard to fundamental rights and freedoms’;

If the answer is in the affirmative, that is to say that it considers compatible with Community law the national rules cited in the preceding paragraphs, is Article 49 EC to be interpreted further as meaning that, where the freedom to provide services is restricted for reasons in the public interest, consideration must be given in advance to whether sufficient account is not already taken of this public interest by the legal provisions, checks and investigations to which the service provider is subject in the State in which he is established?

Notes the Commission's first biennial report on the situation of social services of general interest in the EU; insists that the issue of services of general interest is another important point as regards the revision of the Treaties; in this connection, emphasises the need for clear provisions in EU primary law to ensure that public goods, public services, services of general interest and the non-profit sector are not subject to the rules on competition, state aid, public procurement and the internal market, but form a sector which is guided solely by the public interest and which is organised according to the principle of subsidiarity within the sole competency of the Member States and their respective regional and local authorities to ensure their proper functioning;

In its view, there can be no justification for State involvement in the development of digital terrestrial television based on a public interest argument. Should it be in the public interest to provide digital television, there are many alternative infrastructures that can do so (75).

(25) Il est nécessaire de veiller à ce que toute mesure adoptée en application du présent règlement soit pleinement conforme à l'intérêt de la Communauté; l'évaluation de l'intérêt de la Communauté implique d'identifier tous les motifs impérieux qui peuvent amener à conclure clairement que l'adoption de mesures ne servirait pas l'intérêt général de la Communauté.
(25) It is necessary to ensure that any measures taken by virtue of this Regulation are in full accordance with the Community interest; the assessment of the Community interest involves the identification of any compelling reasons which would lead to the clear conclusion that the taking of measures would not be in the overall interest of the Community.
