Parliament's amendments which were not accepted in the common position of the Council were: amendment 18 concerning the use of citrates and adipates as substitutes, amendments 2 and 9 concerning the addition of fragrances in toys and childcare articles, amendment 5 concerning the extension of application to other products, amendments 11 and 24 concerning the methods of measuring the migration of phthalates, amendment 7 concerning extending the ban to all phthalates, amendments 16 and 17 rev. concerning 0.05% as the ceiling for concentration of phthalates in the plasticised material.

4. La proposition, l'adoption et l'entrée en vigueur d'amendements à l'annexe A, B ou C sont soumises à la même procédure que la proposition, l'adoption et l'entrée en vigueur d'annexes supplémentaires à la convention, si ce n'est qu'un amendement à l'annexe A, B ou C n'entre pas en vigueur à l'égard d'une partie qui a fait une déclaration au sujet des amendements à ces annexes en application du paragraphe 4 de l'article 25, auquel cas l'amendement entre en vigueur pour cette partie le quatre-vingt-dixième jour suivant la date de dépôt auprès du dépositaire de son instrument de ratification, d'acceptation ou d'approbation dudit amendement ou d'adhésion à celui-ci.
4. The proposal, adoption and entry into force of amendments to Annex A, B or C shall be subject to the same procedures as for the proposal, adoption and entry into force of additional Annexes to this Convention, except that an amendment to Annex A, B or C shall not enter into force with respect to any Party that has made a declaration with respect to amendment to those Annexes in accordance with paragraph 4 of Article 25, in which case any such amendment shall enter into force for such a Party on the 90th day after the date of deposit with the depository of its instrument of ratification, acceptance, approval or accession with respect to such amendment.

These amendments relate to the deletion of the title (amendment 51), the threshold levels for the adventitious or technically unavoidable presence of GMOs or of traces of materials produced from GMOs (amendments 26, 52 and 55), mixtures of GMOs (amendment 16) and the standardisation of procedures for the identification of transactions (amendment 50), the doubling of the time for which information must be kept (amendments 17 and 22), derived products (amendment 20), the transmission of information on products which are produced from GMOs but do not contain GMOs (amendment 21), the coexistence of national and Community systems for traceability (amendment 28), entry into force (amendments 32 and 33), deletion of the term ‘produced from GMOs’ (amendment 39) and the application of comitology under Regulation 178/2002/EC (amendment 48).

The remaining 10 amendments incorporated in part or in spirit are concerned with the precautionary principle (amendment 2), the protection of public health and ecosystems (amendment 6), the provision of information to operators and consumers (amendment 35), the exemption of genetically modified micro-organisms (GMMs) from the regulation’s scope (amendment 12), the receipt of pre-packaged products (amendment 24), sample checks and testing (quantitative and qualitative) (amendment 29), the use of comitology for guidance on sampling and testing, but without publication of such guidance (amendment 30), registers with information on GMOs (amendment 31) and the work of the Community Reference Laboratory (amendment 47).

Nous ne pouvons accepter l'amendement 16, les amendements 14, 15, 26, 29, 30 et 75 - pour la raison que j'ai mentionnée précédemment, à savoir qu'ils sont inutiles au vu des développements positifs au sein du Conseil sur ces questions ; les amendements 53, 55 et 76 sur les agents contractuels - car, comme je l'ai dit plus tôt, la Commission soutient les amendements 52 et 54 de la commission juridique et du marché intérieur ; l'amendement 32 sur l'extension de l'article 50 au grade AD 12 - nous estimons que ce ne serait pas adéquat ; l'amendement 63 sur le harcèlement sexuel - la Commission soutient le texte établi par les rapporteurs dans l'amendement 17 ; et enfin l'amendement 64 sur l'indemnité de dépaysement, pour la simple raison que la Commission considère que le versement d'une indemnité au personnel expatrié est justifié et nécessaire objectivement.
We cannot accept Amendment No 16, Amendments Nos 14, 15, 26, 29, 30 and 75 – for the reason that I mentioned earlier, i.e. that they are unnecessary because of positive developments in Council on these questions; Amendments Nos 53, 55 and 76 on contract agents – because, as I said earlier, the Commission supports Amendments Nos 52 and 54 from the Committee on Legal Affairs and the Internal Market; Amendment No 32 on the extension of Article 50 to administrator grade 12 – we do not think that would be appropriate; Amendment No 63 on sexual harassment where the Commission supports the text put by the rapporteurs in Amendment No 17, and finally Amendment No 64 on the expatriation allowance, for the very direct reason that the Commission retains the view that the allowance for staff who are expatriate workers is objectively justified and indeed objectively necessary.

France, Italy, Luxembourg and Spain have a system of a penalty of imprisonment combined with a fine; Belgium has a system of penalties of imprisonment, provides also for a penalty of the deprivation of one's rights as a citizen and has combination of a fine and/or an imprisonment penalty for petty offences; the United Kingdom and Ireland have a system that allows a choice between a penalty of imprisonment or a fine or a combination of the two; Portuguese legislation punishes some conducts only with imprisonment, other conducts with imprisonment or a fine and others only with a fine.
