Member States shall ensure that resolution authorities may apply the bail-in tool for the purpose referred to in point (a) of paragraph 2 of this Article only if there is a reasonable prospect that the application of that tool together with other relevant measures including measures implemented in accordance with the business reorganisation plan required by Article 52 will, in addition to achieving relevant resolution objectives, restore the institution or entity referred to in point (b), (c) or (d) of Article 1(1) in question to financial soundness and long-term viability.

Welcomes the adoption by the United Nations General Assembly of the declaration on the rights of indigenous peoples and congratulates the Council and Member States for backing the adoption of that text, which will create a framework in which States can protect and promote the rights of indigenous people without exclusion or discrimination; at the same time, notes with concern that, without new instruments to guarantee the implementation of the declaration in question, real improvements in the life of indigenous peoples, especially those living under authoritarian and dictatorial regimes, cannot be expected; urges the Commission, therefore, to follow up on the implementation of the declaration, in particular through the European Instrument for Democracy and Human Rights (EIDHR), while in particular enjoining all the Member States to ratify as a matter of urgency International Labour Organization (ILO) Convention 169 on Indigenous and Tribal Peoples, which backs up the principles set out in the declaration in question with a legally binding instrument;

En 2008, puis en 2009, la contribution annuelle du FEDER visée au paragraphe 2 pour laquelle aucun programme opérationnel n'a été soumis à la Commission au 30 juin au plus tard au titre des volets transfrontaliers et bassin maritime des instruments visés au paragraphe 2 est alors mise à la disposition de l'État membre concerné pour le financement de la coopération transfrontalière mentionnée au paragraphe 1, point a), y compris la coopération aux frontières extérieures.
5. In 2008 and in 2009, the annual contribution from the ERDF mentioned in paragraph 2 for which no operational programme has been submitted to the Commission by 30 June at the latest under the cross-border and sea-basin strands of the instruments referred to in paragraph 2 shall then be made available to the Member State concerned for the financing of cross-border cooperation under paragraph 1(a), including cooperation on external borders.
