In particular, actions shall comply with the provisions of the Charter of Fundamental Rights of the European Union, Union data protection law, the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR), the principle of fair treatment of third-country nationals, the right to asylum and international protection, the principle of non-refoulement and the international obligations of the Union and Member States arising from international instruments to which they are signatory such as the Geneva Convention Relating to the Status of Refugees of 28 July 1951, as supplemented by the New York Protocol of 31 January 1967.

B. considérant que l'Union a élaboré une panoplie d'instruments servant de cadre d'action pour faire face à cette obligation, notamment des lignes directrices en matière de droits de l'homme, un instrument financier mondial en matière de droits de l'homme et de démocratie (l'instrument européen pour la démocratie et les droits de l'homme (IEDDH)), une exigence pour les instruments financiers externes – tels que l'instrument de financement de la coopération au développement, l'instrument de stabilité, l'instrument européen de voisinage, l'instrument de pré-adhésion et l'instrument de partenariat – afin de promouvoir les droits de l'homme et la démocratie dans la limite de leurs compétences, la création du FEDEM et la désignation du nouveau représentant spécial de l'Union pour les droits de l'homme, des déclarations et des conclusions du Conseil, des déclarations de la haute représentante, des démarches au niveau de l'Union, des sanctions imposées par l'Union en cas de graves violations des droits de l'homme et, plus récemment, la mise en place de stratégies par pays en matière de droits de l'homme;
B. whereas the EU has developed an extensive toolbox of instruments as a policy framework to support this obligation, including human rights guidelines, a global financial instrument on human rights and democracy (the European Instrument for Democracy and Human Rights (EIDHR)), a requirement for all external financial instruments – such as the Development Cooperation Instrument (DCI), the Instrument for Stability (IfS), the European Neighbourhood Instrument (ENI), the Pre-Accession Instrument (IPA) and the Partnership Instrument (PI) – to promote human rights and democracy within their remit, the establishment of the EED, the appointment of the new EU Special Representative for Human Rights, Council declarations and conclusions, statements by the High Representative, EU démarches, EU sanctions in the event of severe human rights violations and, more recently, human rights country strategies;

La présente convention ne préjuge pas l'application par les États membres de la Communauté européenne du règlement (CE) no 44/2001 du Conseil concernant la compétence judiciaire, la reconnaissance et l'exécution des décisions en matière civile et commerciale, et de toute modification apportée à celui-ci, de la convention concernant la compétence judiciaire et l'exécution des décisions en matière civile et commerciale, signée à Bruxelles le 27 septembre 1968, et du protocole concernant l'interprétation de cette convention par la Cour de justice des Communautés européennes, signé à Luxembourg le 3 juin 1971, tels qu'ils ont été modifiés par les conventions d'adhésion à ladite convention et audit protocole par les États adhérant aux Communautés européennes, ainsi que de l'accord entre la Communauté européenne et le Royaume de Danemark sur la compétence judiciaire, la reconnaissance et l'exécution des décisions en matière civile et commerciale, signé à Bruxelles le 19 octobre 2005.

This Convention shall not prejudice the application by the Member States of the European Community of the Council Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, as well as any amendments thereof, of the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, signed at Brussels on 27 September 1968, and of the Protocol on interpretation of that Convention by the Court of Justice of the European Communities, signed at Luxembourg on 3 June 1971, as amended by the Conventions of Accession to the said Convention and the said Protocol by the States acceding to the European Communities, as well as of the Agreement between the European Community and the Kingdom of Denmark on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, signed at Brussels on 19 October 2005.

7. 7. Insofar as the relations between the Member States of the European Community and the non-European territories referred to in Article 70(1)(b) are concerned, this Convention shall replace the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, signed at Brussels on 27 September 1968, and of the Protocol on interpretation of that Convention by the Court of Justice of the European Communities, signed at Luxembourg on 3 June 1971, as amended by the Conventions of Accession to the said Convention and the said Protocol by the States acceding to the European Communities, as of the date of the entry into force of this Convention with respect to these territories in accordance with Article 73(2).

9. se félicite de l’adoption de la clause de sauvegarde figurant à l'article 38 de l’acte relatif aux conditions d’adhésion en ce qui concerne, en particulier, la reconnaissance mutuelle en matière pénale sous le titre VI du Traité sur l'Union européenne et en matière civile sous le titre IV du traité instituant la Communauté européenne, et invite la Commission à ne pas hésiter à utiliser de manière stricte la clause de sauvegarde si les mesures d'accompagnement ne mènent pas à des résultats satisfaisants ou s’il existe des manquements importants ou un risque imminent d’apparition de tels manquements dans la transposition, la mise en œuvre ou l’application des règles de l’UE, jusqu'à ce qu’il soit remédié à la situation;
9. Welcomes the safeguard clause in Article 38 of the Act concerning the conditions of accession particularly relating to mutual recognition in the area of criminal law under Title VI of the Treaty on European Union and in civil matters under Title IV of the Treaty establishing the European Community, and urges the Commission not to hesitate to make strict use of the safeguard clause if the accompanying measures do not lead to satisfying results or if there are serious shortcomings or any imminent risks of such shortcomings in the transposition, implementation or application of the EU rules, until the situation is remedied;
