It is necessary to recognise the emergence of a new generation of organised trading systems alongside regulated markets which should be subjected to obligations designed to preserve the efficient and orderly functioning of financial markets and to ensure that such organised trading systems do not benefit from regulatory loopholes.

Pour tenir compte de l'évolution technique des marchés financiers et pour assurer une application uniforme de la présente directive, la Commission adopte, conformément à la procédure visée à l'article 24, paragraphe 2, des mesures d'exécution concernant la diffusion de communications à caractère promotionnel annonçant l'intention d'offrir des valeurs mobilières au public ou de faire admettre ces valeurs à la négociation sur un marché réglementé, en particulier avant que le prospectus n'ait été mis à disposition du public ou avant l'ouverture de la souscription, ainsi que des mesures d'exécution concernant le paragraphe 4.
7. In order to take account of technical developments on financial markets and to ensure uniform application of this Directive, the Commission shall, in accordance with the procedure referred to in Article 24(2), adopt implementing measures concerning the dissemination of advertisements announcing the intention to offer securities to the public or the admission to trading on a regulated market, in particular before the prospectus has been made available to the public or before the opening of the subscription, and concerning paragraph 4.
