Individual aid and aid schemes implemented before the date of entry into force of this Regulation and aid granted under those schemes in the absence of a Commission authorisation and in breach of the notification requirement of Article 88(3) of the Treaty shall be compatible with the common market within the meaning of Article 87(3)(c) of the Treaty and shall be exempt if they fulfil the conditions laid down in Article 3 of this Regulation, except the requirements in paragraph 1 and paragraph 2 (b) and (c) of that Article that express reference be made to this Regulation, and that the summary provided for in Article 20(1) has been submitted before granting aid.

nevertheless, where an agricultural or other product or a foodstuff possesses particular characteristics which are due to its geographical origin, it is possible for the producers of the product or foodstuff to apply, through the competent authorities of the Member State concerned, for registration at Community level of a protected designation of origin (PDO) or a protected geographical indication (PGI) in accordance with the provisions of Council Regulation No 510/2006 of 20 March 2006 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs ; the granting of registration means that the Community has recognised the existence of very close links between the specific qualities of the product concerned and its geographical origin; in such cases, the common interest does not oppose the granting of aid for advertising which includes a reference to the origin of the product concerned, provided that the references to origin correspond exactly to those references which have been registered by the Community; similar considerations apply to other designations of origin which are protected under Community legislation, for example wines produced in specified regions in accordance with Articles 54–58 of Council Regulation (EC) No 1493/1999 of 17 May on the common organisation of the market in wine

Regulation (EC) No 994/98 empowers the Commission to declare, in accordance with Article 87 of the Treaty that under certain conditions aid to small and medium-sized enterprises (‘SMEs’), aid in favour of research and development, aid in favour of environmental protection, employment and training aid, and aid that complies with the map approved by the Commission for each Member State for the grant of regional aid is compatible with the common market and not subject to the notification requirement of Article 88(3) of the Treaty.

In addition to the traditional granting of preferences to ACP countries, which already enjoyed tariff-free access, preferential agreements have now been signed with other third countries such as those of the Central American Common Market (CACM) and the Andean Pact as part of the fight against drugs, and the recent inflow from south-east Asian countries following the opening of tariff quotas is creating a major market convulsion which merits close attention and monitoring.
