‘Community harmonisation legislation’ shall mean any Community legislation harmonising the conditions for the marketing of products.

La présente décision énonce le cadre commun de principes généraux et de dispositions de référence pour l'élaboration de la législation communautaire harmonisant les conditions de commercialisation des produits («législation communautaire d'harmonisation»).
This Decision sets out the common framework of general principles and reference provisions for the drawing up of Community legislation harmonising the conditions for the marketing of products (Community harmonisation legislation).

Where Community harmonisation legislation requires a statement by the manufacturer that fulfilment of the requirements relating to a product has been demonstrated (EC declaration of conformity), the legislation shall provide that a single declaration shall be drawn up in respect of all Community acts applicable to the product containing all information required for the identification of Community harmonisation legislation to which the declaration relates, and giving the publication references of the acts concerned.

Believes that, concerning the financial markets, the key issue is the transposition and full implementation of all adopted and on-going EU legislation, as well as the harmonisation across the Member States; recommends strengthening uniform enforcement of existing legislation before proposing additional rules; in the light of new legislation urges the Commission to comply with the better regulation principles avoiding unjustified additional burden on consumers and industry;

Afin de garantir que les produits bénéficiant de la liberté de circulation des marchandises au sein de la Communauté répondent aux exigences d'un haut niveau de protection des intérêts publics tels que la santé et la sécurité en général, la santé et la sécurité sur le lieu de travail, la protection des consommateurs et la protection de l'environnement, tout en garantissant que la libre circulation des produits n'est pas restreinte au-delà de ce qui est autorisé en vertu de la législation communautaire d'harmonisation ou d'autres règles communautaires pertinentes, le présent règlement fournit un cadre d'appui pour les règles spécifiques de la législation communautaire d'harmonisation sectorielle existante ou future sans apporter de modification notable à ladite législation, en particulier en ce qui concerne les règles de ladite législation en matière de protection de la santé et de l'environnement et toute règle spécifique relative à l'accréditation et à la surveillance du marché que peut contenir ladite législation.
1. To ensure that products benefiting from the free movement of goods within the Community respect a high level of protection of public interests such as health and safety in general, health and safety at the workplace, protection of consumers and of the environment, while ensuring that the free movement of products is not restricted beyond what is allowed under Community harmonisation legislation and any other relevant Community rules, this Regulation provides a framework supporting specific rules of existing and future sectoral Community harmonisation legislation, without making any substantive changes to that legislation, in particular not to rules contained therein relating to protection of health and the environment and any specific rules on accreditation and market surveillance that may be contained therein.

Les États membres organisent et réalisent une surveillance efficace en vue de garantir que les produits se trouvant sur le marché communautaire ou introduits sur ce marché qui sont couverts par la législation communautaire d’harmonisation satisfont aux dispositions concernées de cette législation et – à condition d’être correctement installés, entretenus et utilisés – ne présentent pas de risque pour la santé, la sécurité ou d’autres aspects de la protection de l’intérêt public visés dans la législation communautaire d’harmonisation concernée.
Member States shall organise and perform surveillance in order to ensure that products on the Community market, or entering that market, which are covered by Community harmonisation legislation, satisfy the provisions of the relevant Community harmonisation legislation and that they do not, under the condition that they are properly installed, maintained and used, compromise health or safety or other issues of public interest protection set out in the relevant Community harmonisation legislation.
