Vu l’accord sur l’Espace économique européen, signé à Porto le 2 mai 1992, et le protocole portant adaptation de cet accord, signé à Bruxelles le 17 mars 1993, notamment son annexe X, ensemble la loi no 93-1274 du 2 décembre 1993 qui en autorise la ratification et le décret no 94-43 du 1er février 1994 qui en porte publication;
Having regard to the Agreement on the European Economic Area signed at Porto on 2 May 1992 and the Protocol adjusting the Agreement on the European Economic Area signed at Brussels on 17 March 1993, and in particular Annex X thereto, together with Law No 93-1274 of 2 December 1993, which authorises the ratification thereof, and Decree No 94-43 of 1 February 1994, which published it;

24. invite la Commission à prendre toutes les dispositions nécessaires afin d'assurer l'application intégrale de la directive 94/80/CE du Conseil, du 19 décembre 1994, fixant les modalités de l'exercice du droit de vote et d'éligibilité aux élections municipales pour les citoyens de l'Union résidant dans un État membre dont ils n'ont pas la nationalité ainsi que de la directive 93/109/CE du Conseil, du 6 décembre 1993, fixant les modalités de l'exercice du droit de vote et d'éligibilité aux élections au Parlement européen pour les citoyens de l'Union résidant dans un État membre dont ils ne sont pas ressortissants ;
24. Calls on the Commission to take whatever measures are necessary to ensure the full application of Council Directive 94/80/EC of 19 December 1994 laying down detailed arrangements for the exercise of the right to vote and to stand as a candidate in municipal elections by citizens of the Union residing in a Member State of which they are not nationals and Directive 93/109/EC of 6 December 1993 laying down detailed arrangements for the exercise of the right to vote and stand as a candidate in elections to the European Parliament for citizens of the Union residing in a Member State of which they are not nationals ;

considérant, en particulier, que le recours aux articles 100 et 235 du traité comme base juridique de la présente décision est justifié dans la mesure où l'accord instituant l'Organisation mondiale du commerce, y compris ses annexes, affecte, d'une part, la directive no 90/434/CEE du Conseil, du 23 juillet 1990, concernant le régime fiscal commun applicable aux fusions, scissions, apports d'actifs et échanges d'actions intéressant des sociétés d'États membres différents (1) et la directive no 90/435/CEE du Conseil, du 23 juillet 1990, concernant le régime fiscal commun applicable aux sociétés mères et filiales d'États membres différents (2) qui sont fondées sur l'article 100 du traité et, d'autre part, le règlement (CE) no 40/94 du Conseil, du 20 décembre 1993, sur la marque communautaire (3), qui est fondé sur l'article 235 du traité;
Whereas, in particular, the use of Articles 100 and 235 of the Treaty as legal bases for this Decision is justified to the extent that the Agreement establishing the World Trade Organization, including the Annexes thereto, affects Council Directive 90/434/EEC of 23 July 1990 on the common system of taxation applicable to mergers, divisions, transfers of assets and exchanges of shares concerning companies of different Member States (1), Council Directive 90/435/EEC of 23 July 1990 on the common system of taxation applicable in the case of parent companies and subsidiaries of different Member States (2), which are based on Article 100 of the Treaty, and Council Regulation (EC) No 40/94 of 20 December 1993 on the Community trade mark (3), which is based on Article 235 of the Treaty;
