1. Where measures are taken by a Member State in an area adjacent to the border with another Member State, a report on the measures taken in accordance with Articles 17, 18 and 19 shall be submitted to that other Member State.

En procédant à l’échange des ratifications du traité signé à Washington le 11 janvier 1909, entre la Grande-Bretagne et les États-Unis, relativement aux eaux limitrophes et aux questions qui surgissent le long de la frontière entre les États-Unis et le Dominion du Canada, les plénipotentiaires soussignés régulièrement autorisés à cet effet par leurs gouvernements respectifs, déclarent par les présentes que rien dans ce traité ne doit être interprété comme devant affecter ou changer aucun des droits territoriaux ou riverains existants sur les eaux, ni les droits des propriétaires de terres sous l’eau, d’un côté ou d’un autre de la frontière internationale, aux rapides de la rivière de Sainte-Marie à Sault-Sainte-Marie, dans l’usage qui sera fait des eaux coulant sur lesdites terres subordonnément aux exigences de la navigation dans les eaux limitrophes et dans les canaux et sans préjudice des droits actuels des États-Unis et du Canada, chacun des deux pays devant faire usage des eaux de la rivière Sainte-Marie qui sont situées dans son propre territoire; en outre que rien dans le présent traité ne doit être considéré comme devant gêner l’égouttement des terrains humides, des marécages, ou des terres inondées, par les ruisseaux qui se jettent dans les eaux limitrophes, et aussi que la présente déclaration sera considérée comme ayant la même valeur et le même effet que le traité lui-même, et comme en formant une partie intégrale.
On proceeding to the exchange of the ratifications of the treaty signed at Washington on January 11, 1909, between Great Britain and the United States, relating to boundary waters and questions arising along the boundary between the United States and the Dominion of Canada, the undersigned plenipotentiaries, duly authorized thereto by their respective Governments, hereby declare that nothing in this treaty shall be construed as affecting, or changing, any existing territorial, or riparian rights in the water, or rights of the owners of lands under water, on either side of the international boundary at the rapids of St. Mary’s River at Sault Ste. Marie, in the use of the waters flowing over such lands, subject to the requirements of navigation in boundary waters and of navigation canals, and without prejudice to the existing right of the United States and Canada, each to use the waters of the St. Mary’s River, within its own territory; and further, that nothing in this treaty shall be construed to interfere with the drainage of wet, swamp, and overflowed lands into streams flowing into boundary waters, and also that this declaration shall be deemed to have equal force and effect as the treaty itself and to form an integral part thereto.

Il est convenu que, outre les usages, obstructions et détournements permis jusqu’ici ou autorisés ci-après, par convention spéciale entre les parties, aucun usage ou obstruction ou détournement nouveaux ou autres, soit temporaires ou permanents des eaux limitrophes, d’un côté ou de l’autre de la frontière, influençant le débit ou le niveau naturels des eaux limitrophes de l’autre côté de la frontière, ne pourront être effectués si ce n’est par l’autorité des États-Unis ou du Dominion canadien dans les limites de leurs territoires respectifs et avec l’approbation, comme il est prescrit ci-après, d’une commission mixte qui sera désignée sous le nom de « Commission mixte internationale ».
It is agreed that, in addition to the uses, obstructions, and diversions heretofore permitted or hereafter provided for by special agreement between the Parties hereto, no further or other uses or obstructions or diversions, whether temporary or permanent, of boundary waters on either side of the line, affecting the natural level or flow of boundary waters on the other side of the line, shall be made except by authority of the United States or the Dominion of Canada within their respective jurisdictions and with the approval, as hereinafter provided, of a joint commission, to be known as the International Joint Commission.

The foregoing provisions are not intended to limit or interfere with the existing rights of the Government of the United States on the one side and the Government of the Dominion of Canada on the other, to undertake and carry on governmental works in boundary waters for the deepening of channels, the construction of breakwaters, the improvement of harbors, and other governmental works for the benefit of commerce and navigation, provided that such works are wholly on its own side of the line and do not materially affect the level or flow of the boundary waters on the other, nor are such provisions intended to interfere with the ordinary use of such waters for domestic and sanitary purposes.

Clause 2: Existing text of section 13: 13 (1) Despite section 11, no person shall use or divert boundary waters by removing water from the boundary waters and taking it outside the water basin in which the boundary waters are located (2) For the purpose of subsection (1) and the application of the treaty, removing water from boundary waters and taking it outside the water basin in which the boundary waters are located is deemed, given the cumulative effect of removals of boundary waters outside their water basins, to affect the natural level or flow of the boundary waters on the other side of the international boundary (3) Subsection (1) applies only in respect of the water basins described in the regulations (4) Subsection (1) does not apply in respect of the exceptions specified in the regulations.

5. 5. Areas in countries other than Member States or other cross-border cooperation participating countries which adjoin eligible areas as defined in points (a) and (b) of Article 8(1) or which face a common sea basin where a joint operational programme is being established may be covered by a joint operational programme and may benefit from Union support under this Regulation in accordance with the conditions set out in the programming document referred to in Article 9(1).

In order to facilitate the transport of consignments through third countries neighbouring more than one Member State, a special regime for the dispatch of consignments from the territory of one Member State to another through the territory of a third country should be introduced in order to ensure, in particular, that consignments re-entering Community territory are subject to veterinary checks in accordance with Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market

Il est vrai que le Compact fait référence au Traité des eaux limitrophes, mais il le fait à l'intérieur d'un régime entièrement parallèle, y compris un processus d'appel entièrement différent du rôle joué par la CMI dans le processus.
In the Boundary Waters Treaty, article 3 provides that the IJC is to approve diversions that, in the key words, “affect the level or flow of.waters on the other” side of the boundary.If you look at the approach that Bill C-6 has taken to that issue, it clearly references the treaty; it deems any diversion of water from the lakes to have that consequence, thereby invoking the jurisdiction of the IJC.

(4) Le règlement (CE) n° 2760/98 de la Commission(4), modifié par le règlement (CE) n° 1596/2002(5), envisage d'étendre le programme Phare de coopération transfrontalière aux frontières avec d'autres pays limitrophes bénéficiant d'autres programmes d'assistance de la Communauté. Il convient d'intégrer aussi dans le programme Phare de coopération transfrontalière la frontière bulgare avec la Turquie.
(4) Commission Regulation (EC) No 2760/98(4), as amended by Regulation (EC) No 1596/2002(5), envisages the extension of the Phare cross-border cooperation programme to borders with other neighbouring countries benefiting from other Community assistance programmes; it is appropriate to extend the Phare cross-border cooperation programme to cover also the Bulgarian border with Turkey.
