Il est essentiel que les États membres veillent à ce que soient évités des actes préjudiciables à la libre circulation et au commerce des émissions télévisées ou susceptibles de favoriser la formation de positions dominantes qui imposeraient des limites au pluralisme et à la liberté de l’information télévisée ainsi que de l’information dans son ensemble.
It is essential for the Member States to ensure the prevention of any acts which may prove detrimental to freedom of movement and trade in television programmes or which may promote the creation of dominant positions which would lead to restrictions on pluralism and freedom of televised information and of the information sector as a whole.

1. Les États membres veillent à ce que les cartes de bruit stratégiques qu'ils ont établies et, le cas échéant, approuvées, ainsi que les plans d'action qu'ils ont arrêtés, soient rendus accessibles et diffusés au public conformément à la législation communautaire pertinente, notamment la directive 90/313/CEE du Conseil du 7 juin 1990 concernant la liberté d'accès à l'information en matière d'environnement(13), et conformément aux annexes IV et V de la présente directive, y compris au moyen des technologies de l'information disponibles.
1. Member States shall ensure that the strategic noise maps they have made, and where appropriate adopted, and the action plans they have drawn up are made available and disseminated to the public in accordance with relevant Community legislation, in particular Council Directive 90/313/EEC of 7 June 1990 on the freedom of access to information on the environment(13), and in conformity with Annexes IV and V to this Directive, including by means of available information technologies.

(52) L'exercice effectif des libertés du marché intérieur nécessite de garantir aux victimes un accès efficace aux règlements des litiges. Les dommages qui peuvent se produire dans le cadre des services de la société de l'information se caractérisent à la fois par leur rapidité et leur étendue géographique. En raison de cette spécificité et de la nécessité de veiller à ce que les autorités nationales ne mettent pas en cause la confiance qu'elles doivent s'accorder mutuellement, la présente directive invite les États membres à faire en sorte que les recours juridictionnels appropriés soient disponibles. Les États membres doivent évaluer la nécessité de fournir un accès aux procédures juridictionnelles par les moyens électroniques appropriés.
(52) The effective exercise of the freedoms of the internal market makes it necessary to guarantee victims effective access to means of settling disputes; damage which may arise in connection with information society services is characterised both by its rapidity and by its geographical extent; in view of this specific character and the need to ensure that national authorities do not endanger the mutual confidence which they should have in one another, this Directive requests Member States to ensure that appropriate court actions are available; Member States should examine the need to provide access to judicial procedures by appropriate electronic means.
