En coopération avec les États membres, la Commission et la haute représentante entendent: · œuvrer à une politique internationale de l'UE cohérente en matière de cyberespace afin d'approfondir la collaboration avec les principaux partenaires et organisations internationaux, d'intégrer les questions inhérentes au cyberespace à la PESC et d'améliorer la coordination de celles qui ont une dimension mondiale; · soutenir l'élaboration de règles de conduite et de mesures de confiance en matière de cybersécurité, faciliter le dialogue sur la façon d'appliquer le droit international existant dans le cyberespace et promouvoir la convention de Budapest pour lutter contre la cybercriminalité; · soutenir la défense et la protection des droits fondamentaux, y compris l'accès à l'information et la liberté d'expression, en s'attachant à: a) établir de nouvelles orientations publiques sur la liberté d'expression en ligne et hors ligne; b) contrôler l'exportation des produits et services qui pourraient être utilisés à des fins de censure ou de surveillance de masse en ligne; c) mettre au point des mesures et des outils permettant d'élargir l'accès à Internet, d'accroître son ouverture et sa résilience pour échapper à la censure ou la surveillance de masse par les technologies des communications; d) habiliter les parties prenantes à utiliser les technologies des communications pour promouvoir les droits fondamentaux; · s'employer, aux côtés des principaux partenaires et organisations internationaux, du secteur privé et de la société civile, à aider les pays tiers à se doter de moyens de portée mondiale afin d'améliorer l'accès à l'information et à un Internet ouvert, à prévenir et affronter les cybermenaces, y compris les événements accidentels, la cybercriminalité et le cyberterrorisme, et à renforcer la coordination entre les donateurs afin de canaliser les efforts dans ce sens; · recourir à différents dispositifs d'aide de l'UE pour la mise en place de moyens de cybersécuri ...
In cooperation with the Member States, the Commission and the High Representative will: · Work towards a coherent EU International cyberspace policy to increase engagement with key international partners and organisations, to mainstream cyber issues into CFSP, and to improve coordination of global cyber issues; · Support the development of norms of behaviour and confidence building measures in cybersecurity. Facilitate dialogues on how to apply existing international law in cyberspace and promote the Budapest Convention to address cybercrime; · Support the promotion and protection of fundamental rights, including access to information and freedom of expression, focusing on: a) developing new public guidelines on freedom of expression online and offline; b) monitoring the export of products or services that might be used for censorship or mass surveillance online; c) developing measures and tools to expand Internet access, openness and resilience to address censorship or mass surveillance by communication technology; d) empowering stakeholders to use communication technology to promote fundamental rights; · Engage with international partners and organisations, the private sector and civil society to support global capacity-building in third countries to improve access to information and to an open Internet, to prevent and counter cyber threats, including accidental events, cybercrime and cyber terrorism, and to develop donor coordination for steering capacity-building efforts; · Utilise different EU aid instruments for cybersecurity capacity building, including assisting the training of law enforcement, judicial and technical personnel to address cyber threats; as well as supporting the creation of relevant national policies, strategies and institutions in third countries; · Increase policy coordination and information sharing through the international Critical Information Infrastructure Protection networks such as the Meridian network, cooperation among NIS ...

La présente directive respecte les principes reconnus par l’article 2 du traité sur l’Union européenne, ainsi que les droits et libertés fondamentaux, et observe les principes consacrés notamment par la charte, y compris ceux énoncés dans ses titres II, III, V et VI concernant, entre autres, le droit à la liberté et à la sûreté, la liberté d’expression et d’information, la liberté d’association et la liberté de pensée, de conscience et de religion, l’interdiction générale de toute discrimination fondée notamment sur la race, la couleur, les origines ethniques ou sociales, les caractéristiques génétiques, la langue, la religion ou les convictions, les opinions politiques ou toute autre opinion, le droit au respect de la vie privée et familiale et le droit à la protection des données à caractère personnel, les principes de légalité et de proportionnalité des délits et des peines, qui englobent également les exigences de précision, de clarté et de prévisibilité en droit pénal, la présomption d’innocence, ainsi que la liberté de circulation telle qu’établie à l’article 21, paragraphe 1, du traité sur le fonctionnement de l’Union européenne et dans la directive 2004/38/CE du Parlement européen et du Conseil .
This Directive respects the principles recognised by Article 2 TEU, respects fundamental rights and freedoms and observes the principles recognised, in particular, by the Charter, including those set out in Titles II, III, V and VI thereof which encompass, inter alia, the right to liberty and security, freedom of expression and information, freedom of association and freedom of thought, conscience and religion, the general prohibition of discrimination, in particular on grounds of race, colour, ethnic or social origin, genetic features, language, religion or belief, political or any other opinion, the right to respect for private and family life and the right to protection of personal data, the principles of legality and proportionality of criminal offences and penalties, covering also the requirement of precision, clarity and foreseeability in criminal law, the presumption of innocence as well as freedom of movement as set out in Article 21(1) of the Treaty on the Functioning of the European Union (TFEU) and in Directive 2004/38/EC of the European Parliament and of the Council .

Articles 11 and 12 of the Charter state that the right to freedom of association at all levels, for example in political and civic matters, and the right to freedom of expression, which includes the freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers, are fundamental rights of every citizen of the Union.

The fundamental freedoms of thought, conscience and religion or belief, expression, assembly and association are the preconditions for political pluralism, democratic process and an open society, whereas democratic control, domestic accountability and the separation of powers are essential to sustain an independent judiciary and the rule of law which in turn are required for effective protection of human rights.

whereas the OSCE expressed serious reservations regarding the scope of the Hungarian laws (material and territorial scope), freedom of expression and the regulation of content, the appointment of one person to act as the national media and telecommunications authority, and compliance with the principles governing public-service broadcasting (4), indicating that the new legislation undermined media pluralism, abolished the political and financial independence of the public-service media and cemented the negative features for the free media in the long term, and that the Media Authority and Media Council were politically homogeneous (5) and exerted pervasive and centralised governmental and political control over all media; whereas further concerns included the disproportionate and extreme penalties imposed for debatable and undefined reasons, the lack of an automatic procedure for suspending penalties in the event of an appeal to the courts against a Media Authority ruling, the violation of the principle of the confidentiality of journalistic sources and the protection of family values,
