Welcomes a number of important decisions taken by the Constitutional Court of Turkey protecting the rule of law and fundamental rights, such as freedom of expression, which has illustrated the resilience of the constitutional system; notes, in addition, that the Constitutional Court’s rulings highlighted the mishandling of the investigations and subsequent trials in the Ergenekon and Sledgehammer cases; welcomes the fact that the Constitutional Court continues to receive individual applications; expresses concern at the amendments to the Criminal Code, and particularly the use of the term ‘reasonable suspicion’, which opens the door to arbitrary attacks on the opposition; points out that these amendments were adopted without the Commission being consulted, contrary to what was agreed during the negotiations;

Mr. Mark-André Blanchard, Chair, Freedom of Expression Committee, National Media and Communications Law Section: The National Media and Communications Law Section of the Canadian Bar Association is of the opinion that Bill C-220 is unconstitutional in that it violates section 2b) of the Canadian Charter of Rights and Freedoms guaranteeing freedom of expression.

I. whereas Article 65 of the Egyptian Constitution declares that freedom of thought and opinion is guaranteed, and that every person shall have the right to express his or her opinion verbally, in writing, through imagery, or by any other means of expression and publication; whereas, in its preliminary statement, the EU Election Observation Mission to the presidential elections in Egypt of May 2014 said that although the new constitution set out a wide-ranging catalogue of fundamental rights, respect for these rights fell short of the constitutional principles, and that a general climate of limited freedom of expression, leading to self-censorship by journalists, could be observed in the country;

Le Programme vise les droits linguistiques constitutionnels suivants : les droits relatifs aux langues officielles garantis par l'interprétation ou l'application de l'article 93 ou 133 de la Loi constitutionnelle de 1867, ou garantis par l'article 23 de la Loi sur le Manitoba de 1870, ou par les articles 16 à 23 de la Loi constitutionnelle de 1982, ou par des dispositions constitutionnelles équivalentes; ou la clarification de l'aspect linguistique de la liberté d'expression garantie par l'article 2 de la Charte canadienne des droits et libertés lorsque cette liberté est invoquée dans une cause intéressant une minorité de langue officielle.
The Program targets the following constitutional language rights: official language rights as guaranteed by the interpretation or application of section 93 or 133 of the Constitution Act, 1867, or as guaranteed in section 23 of the Manitoba Act, 1870, sections 16 to 23 of the Constitution Act, 1982, or equivalent constitutional provisions, or the clarification of the linguistic aspect of freedom of expression in section 2 of the Canadian Charter of Rights and Freedoms, when invoked in an official language minority case.

2. La présente décision-cadre n'a pas pour effet d'obliger les États membres à prendre des mesures contraires aux principes fondamentaux relatifs à la liberté d'association et à la liberté d'expression, et en particulier à la liberté de la presse et à la liberté d'expression dans d'autres médias, tels qu'ils résultent des traditions constitutionnelles ou des règles régissant les droits et responsabilités de la presse ou d'autres médias ainsi que les garanties de procédure en la matière, lorsque ces règles portent sur la détermination ou la limitation de la responsabilité.
2. This Framework Decision shall not have the effect of requiring Member States to take measures in contradiction to fundamental principles relating to freedom of association and freedom of expression, in particular freedom of the press and the freedom of expression in other media as they result from constitutional traditions or rules governing the rights and responsibilities of, and the procedural guarantees for, the press or other media where these rules relate to the determination or limitation of liability.

2. La présente décision-cadre n'a pas pour effet d'obliger les États membres à prendre des mesures contraires aux principes fondamentaux communs aux États membres et relatifs à la liberté d'association et à la liberté d'expression, et en particulier à la liberté de la presse et à la liberté d'expression dans d'autres médias, tels qu'ils résultent des traditions constitutionnelles ou des règles régissant les droits et responsabilités de la presse ou d'autres médias ainsi que les garanties de procédure en la matière, lorsque ces règles portent sur la détermination ou la limitation de la responsabilité.

This Framework Decision shall not have the effect of requiring Member States to take measures in contradiction with the common fundamental principles of the Member States relating to freedom of association and freedom of expression, in particular freedom of the press and the freedom of expression in other media as they result from constitutional traditions or rules governing the rights and responsibilities of, and the procedural guarantees for, the press or other media where these rules relate to the determination or limitation of liability.

La décision-cadre n'empêche pas un État membre d'appliquer ses règles constitutionnelles relatives au respect de la légalité, à la liberté d'association, à la liberté de la presse et à la liberté d'expression dans d'autres médias.
This Framework Decision does not prevent any Member State from applying its constitutional rules relating to due process, freedom of association, freedom of the press and freedom of expression in other media.
